This Convention shall remain in force until terminated by a Contracting State. Either Contracting State may terminate the Convention, through diplomatic channel, by giving a notice specifying the year of termination at least six months before 31st December of the year so specified in the said notice. A notice may only be given after the expiration of a period of five years from the date on which the Convention enters into force. In such event, the Convention shall cease to have effect:
A presente Convenção permanecerá em vigor enquanto não for denunciada por um Estado Contratante. Qualquer Estado Contratante pode denunciar a Convenção, por via diplomática, mediante um aviso prévio especificando o ano da cessação pelo menos seis meses antes de 31 de Dezembro do ano especificado no referido aviso. O aviso só poderá ser efectuado depois de decorrido um período de cinco anos a contar da data da entrada em vigor da Convenção. Nesse caso, a Convenção deixará de se aplicar:
(i) in respect of taxes withheld at source, the fact giving rise to them appearing on or after the first day of January of the year next following that specified in the said notice of termination;
i) Aos impostos devidos na fonte cujo facto gerador surja em ou a partir de 1 de Janeiro do ano imediatamente seguinte ao mencionado no aviso de denúncia;
(ii) in respect of other taxes, as to income arising in the fiscal year beginning on or after the first day of January of the year next following that specified in the said notice of termination;
ii) Aos demais impostos, relativamente aos rendimentos realizados no ano fiscal com início em ou a partir de 1 de Janeiro do ano imediatamente seguinte ao mencionado no aviso de denúncia;
(i) in respect of taxes withheld at source, on income derived on or after the first day of January of the year next following that specified in the said notice of termination;
i) Aos impostos retidos na fonte, sobre os rendimentos realizados em ou a partir de 1 de Janeiro do ano imediatamente seguinte ao mencionado no aviso de denúncia;
(ii) in respect of other taxes, to taxes chargeable for any taxable year or period beginning on or after the first day of January of the year next following that specified in the said notice of termination.
ii) Aos demais impostos, relativamente aos impostos imputáveis a qualquer ano fiscal ou exercício com início em ou a partir de 1 de Janeiro do ano imediatamente seguinte ao mencionado no aviso de denúncia.
IN WITNESS WHEREOF the undersigned, duly authorised thereto, have signed this Convention.
Em testemunho do qual os signatários, devidamente autorizados para o efeito, assinaram a presente Convenção.
DONE at Oporto this 20st day of September 1999, in duplicate, in the Netherlands, Portuguese and English languages, the three texts being equally authentic. In case there is any divergence of interpretation between the Netherlands and Portuguese texts, the English text shall prevail.
Feito em duplicado, no Porto, aos 20 dias do mês de Setembro de 1999, nas línguas portuguesa, neerlandesa e inglesa, sendo as três versões igualmente válidas. No caso de divergência de interpretação entre os textos português e neerlandês, prevalecerá o texto inglês.
