1. Any omission, inaccuracy, discrepancy or lack of updating in the information contained in the RCBE shall be reported to the managing entity of the RCBE by any of the following interested parties:
1 - A omissão, a inexatidão, a desconformidade ou a desatualização da informação constante do RCBE deve ser comunicada à entidade gestora do RCBE por qualquer dos seguintes interessados:
a) The entity subject to the RCBE itself, where it finds that the declaration was made by a person who, at the time, lacked standing or powers of representation;
a) A própria entidade sujeita ao RCBE, nos casos em que verifique que a declaração foi efetuada por pessoa que, à data, não tinha legitimidade ou poderes de representação;
c) The authorities pursuing criminal investigation purposes, the supervisory and oversight authorities, the Financial Intelligence Unit and the Tax and Customs Authority (AT);
c) As autoridades que prossigam fins de investigação criminal, as autoridades de supervisão e fiscalização, a Unidade de Informação Financeira e a AT;
d) Obliged entities within the meaning of Law No. 83/2017 of 18 August, where they detect such omissions, inaccuracies, discrepancies or lack of updating in the course of performing the preventive duties to which they are subject.
d) As entidades obrigadas, na aceção da Lei n.º 83/2017, de 18 de agosto, quando detetem tais omissões, inexatidões, desconformidades ou desatualizações no exercício dos deveres preventivos a que se encontram sujeitas.
2. Whenever an omission, inaccuracy, discrepancy or lack of updating in the information is reported by anyone other than the entity subject to the RCBE, the managing entity of the RCBE shall notify that entity to rectify it, or to submit a justification exempting it from doing so, within 10 days.
2 - Sempre que seja comunicada uma omissão, inexatidão, desconformidade ou desatualização da informação, que não pela entidade sujeita ao RCBE, a entidade gestora do RCBE notifica-a para, no prazo de 10 dias, proceder à sua retificação ou apresentar justificação que a dispense.
3. The report, the rectification declaration and the justification referred to in the preceding paragraph shall be recorded in the RCBE.
3 - A comunicação, a declaração de retificação e a justificação a que se refere o número anterior devem ficar consignadas no RCBE.
4. The reports, notifications and rectification declarations provided for in the preceding paragraphs shall be made under terms to be laid down by order (portaria) of the members of the Government responsible for finance and justice.
4 - As comunicações, notificações e declarações de retificação previstas nos números anteriores são efetuadas nos termos a definir por portaria dos membros do Governo responsáveis pelas áreas das finanças e da justiça.
