1. Anyone who habitually uses the work of foreign nationals who do not hold a residence permit or visa allowing them to stay legally in Portugal shall be punished with imprisonment of up to one year or a fine of up to 240 days.
1 - Quem, de forma habitual, utilizar o trabalho de cidadãos estrangeiros que não sejam titulares de autorização de residência ou visto que habilite a que permaneçam legalmente em Portugal, é punido com pena de prisão até um ano ou com pena de multa até 240 dias.
2. Anyone who, in the cases referred to in the preceding paragraph, simultaneously uses the activity of a significant number of foreign nationals in an illegal situation shall be punished with imprisonment of up to two years or a fine of up to 480 days.
2 - Quem, nos casos a que se refere o número anterior, utilizar, em simultâneo, a atividade de um número significativo de cidadãos estrangeiros em situação ilegal, é punido com pena de prisão até dois anos ou pena de multa até 480 dias.
3. Anyone who uses the work of a foreign national who is a minor and in an illegal situation, even if the minor is permitted to work under the Labour Code, shall be punished with imprisonment of up to two years or a fine of up to 480 days.
3 - Quem utilizar o trabalho de cidadão estrangeiro, menor de idade, em situação ilegal, ainda que admitido a prestar trabalho nos termos do Código do Trabalho, é punido com pena de prisão até dois anos ou com pena de multa até 480 dias.
4. If the conduct referred to in the preceding paragraphs is accompanied by particularly abusive or degrading working conditions, the perpetrator shall be punished with imprisonment of one to five years, unless a more severe penalty applies under another legal provision.
4 - Se as condutas referidas nos números anteriores forem acompanhadas de condições de trabalho particularmente abusivas ou degradantes, o agente é punido com pena de prisão de um a cinco anos, se pena mais grave não couber por força de outra disposição legal.
5. An employer or user of the work or services of a foreign national in an illegal situation who knows that the foreign national is a victim of criminal offences linked to trafficking in human beings shall be punished with imprisonment of two to six years, unless a more severe penalty applies under another legal provision.
5 - O empregador ou utilizador do trabalho ou serviços de cidadão estrangeiro em situação ilegal, com o conhecimento de ser este vítima de infrações penais ligadas ao tráfico de pessoas, é punido com pena de prisão de dois a seis anos, se pena mais grave não couber por força de outra disposição legal.
6. In the event of recidivism, the limits of the penalties are increased under the general rules.
6 - Em caso de reincidência, os limites das penas são elevados nos termos gerais.
7. The penalty applicable to the entities referred to in Article 182(1) is a fine, the minimum and maximum limits of which are doubled, and a ban on carrying on the activity for a period of three months to five years may also be imposed.
7 - As penas aplicáveis às entidades referidas no n.º 1 do artigo 182.º são as de multa, cujos limites mínimo e máximo são elevados ao dobro, podendo ainda ser declarada a interdição do exercício da atividade pelo período de três meses a cinco anos.
