1. The entry of foreign nationals into Portuguese territory or into the territory of the Member States of the European Union and of the States in which the Implementing Convention is in force shall be deemed illegal where it breaches Articles 6, 9 and 10 and Article 32(1) and (2), or the Schengen Borders Code.
1 - Considera-se ilegal a entrada de cidadãos estrangeiros em território português ou no território dos Estados membros da União Europeia e nos Estados onde vigore a Convenção de Aplicação em violação do disposto nos artigos 6.º, 9.º e 10.º e nos n.os 1 e 2 do artigo 32.º, assim como no disposto no Código de Fronteiras Schengen.
2. The stay of foreign nationals in Portuguese territory shall be deemed illegal where:
2 - Considera-se ilegal a permanência de cidadãos estrangeiros em território português quando:
a) The stay has not been authorised in accordance with this Law or with the law governing the right of asylum;
a) A permanência não tenha sido autorizada em harmonia com o disposto na presente lei ou na lei reguladora do direito de asilo;
b) The foreign nationals have ceased to fulfil the entry conditions or have exceeded the authorised duration of stay in Portuguese territory or in that of the Member States of the European Union and of the States in which the Implementing Convention is in force;
b) Os cidadãos estrangeiros tenham deixado de cumprir as condições de entrada ou excedido a duração da estada autorizada no território português ou no dos Estados membros da União Europeia e no dos Estados onde vigore a Convenção de Aplicação;
c) The residence cards of the foreign nationals have lapsed or been cancelled;
c) Os títulos de residência dos cidadãos estrangeiros tenham caducado ou sido cancelados;
d) Illegal entry within the meaning of the preceding paragraph has taken place.
d) Se tenha verificado a entrada ilegal nos termos do número anterior.
3. The transit of foreign nationals through Portuguese territory shall be deemed illegal where their admission to the country of destination is not guaranteed.
3 - Considera-se ilegal o trânsito de cidadãos estrangeiros em território português quando estes não tenham garantida a sua admissão no país de destino.
