1. The decision on the organisation of, or participation by the Portuguese State in, joint flights for the removal from the territory of two or more Member States of third-country nationals who are subject to a forced removal or judicial expulsion decision lies with the National Director of the PSP.
1 - A decisão de organização ou participação do Estado Português em voos comuns para afastamento do território de dois ou mais Estados membros de cidadãos nacionais de países terceiros objeto de decisão de afastamento coercivo ou de expulsão judicial é da competência do diretor nacional da PSP.
2. That decision shall be guided by principles of effectiveness through the sharing of existing resources and, in particular, by compliance with the international conventions or agreements on human rights that are binding on the Member States.
2 - A referida decisão pauta-se por princípios de eficácia através da partilha dos recursos existentes e, em especial, pela observância das convenções ou acordos internacionais em matéria de direitos humanos que vinculam os Estados membros.
3. Whenever it is decided to organise a joint removal operation by air that is open to the participation of the other Member States, the following must be ensured:
3 - Sempre que se decida organizar uma operação conjunta de afastamento por via aérea aberta, à participação dos restantes Estados membros, deve obrigatoriamente assegurar-se:
a) The provision of essential information to the competent national authorities of the other Member States, in order to ascertain whether they are interested in participating in the operation;
a) A informação indispensável às competentes autoridades nacionais dos outros Estados membros, com vista a averiguar do respetivo interesse em participar na operação;
b) The implementation of the measures necessary for the proper conduct of the joint operation, having regard in particular to Article 4 of Council Decision 2004/573/EC of 29 April and its Annex.
b) A implementação das medidas necessárias ao adequado desenvolvimento da operação conjunta tendo presente, designadamente, o disposto no artigo 4.º da Decisão do Conselho n.º 2004/573/CE, de 29 de abril, e respetivo anexo.
4. For the purposes of the preceding paragraph, the organising national authority undertakes, in accordance with the common guidelines on security provisions set out in that Annex, to:
4 - Para efeitos do número anterior, a autoridade nacional organizadora compromete-se, em harmonia com as orientações comuns em matéria de disposições de segurança constantes do referido anexo, a:
a) Take steps to ensure that the third-country nationals hold valid travel documents and, where necessary, entry visas for the country or countries of transit or destination of the joint flight;
a) Diligenciar para que os nacionais de países terceiros sejam portadores de documentos de viagem válidos, bem como de vistos de entrada, se necessário, para o país ou países de trânsito ou de destino do voo comum;
b) Provide appropriate medical, medication and language assistance, as well as escort services, whose conduct shall comply with the principles of necessity, proportionality and identification laid down in Article 180;
b) Prestar a adequada assistência médica, medicamentosa e linguística, bem como serviços de escolta, cuja atuação obedece aos princípios de necessidade, proporcionalidade e de identificação previstos no artigo 180.º;
c) Monitor each joint removal operation through observation by a suitable body, to be designated by order (despacho) of the member of the Government responsible for internal administration;
c) Monitorizar cada operação conjunta de afastamento, mediante acompanhamento por entidade idónea, a designar por despacho do membro do Governo responsável pela área da administração interna;
d) Draw up an internal and confidential report on the joint removal operation incorporating, preferably and where they exist, statements on incidents or on the use of coercive or medical measures and the partial reports of the other participating Member States.
d) Elaborar relatório interno e confidencial da operação conjunta de afastamento integrando, preferencialmente e caso existam, declarações de incidentes ou de aplicação de medidas coercivas ou médicas e os relatórios parciais dos outros Estados membros participantes.
5. Without prejudice to compliance with Council Decision 2004/573/EC and its Annex, the rules laid down in this Article shall apply, with the necessary adaptations, to the participation of the Portuguese State in joint operations organised by other Member States.
5 - Sem prejuízo da observância da Decisão do Conselho n.º 2004/573/CE e respetivo anexo, à participação do Estado Português nas operações conjuntas organizadas por outros Estados membros aplica-se, com as necessárias adaptações, o regime constante do presente artigo.
