1. Without prejudice to the provisions of international conventions to which Portugal is a party or by which it becomes bound, a foreign national is subject to forced removal or judicial expulsion from Portuguese territory where that foreign national:
1 - Sem prejuízo das disposições constantes de convenções internacionais de que Portugal seja Parte ou a que se vincule, é afastado coercivamente ou expulso judicialmente do território português, o cidadão estrangeiro:
a) Enters or stays illegally in Portuguese territory;
a) Que entre ou permaneça ilegalmente no território português;
b) Endangers national security or public policy;
b) Que atente contra a segurança nacional ou a ordem pública;
c) Is someone whose presence or activities in the country constitute a threat to the interests or dignity of the Portuguese State or its nationals;
c) Cuja presença ou actividades no País constituam ameaça aos interesses ou à dignidade do Estado Português ou dos seus nacionais;
d) Improperly interferes in the exercise of political participation rights reserved to Portuguese citizens;
d) Que interfira de forma abusiva no exercício de direitos de participação política reservados aos cidadãos nacionais;
e) Has committed acts which, had they been known to the Portuguese authorities, would have prevented that person’s entry into the country;
e) Que tenha praticado actos que, se fossem conhecidos pelas autoridades portuguesas, teriam obstado à sua entrada no País;
f) Is someone in respect of whom there are serious grounds for believing that they have committed serious criminal acts or intend to commit such acts, in particular in the territory of the European Union;
f) Em relação ao qual existam sérias razões para crer que cometeu atos criminosos graves ou que tenciona cometer atos dessa natureza, designadamente no território da União Europeia;
g) Holds a valid residence card or other document conferring a right of stay in another Member State and fails to comply with the obligation to go immediately to that Member State.
g) Que seja detentor de um título de residência válido ou de outro título que lhe confira direito de permanência em outro Estado membro e não cumpra a obrigação de se dirigir, imediatamente, para esse Estado membro.
h) Has circumvented or attempted to circumvent the rules applicable to entry and stay in national territory or in the territory of the Member States of the European Union or of the States in which the Implementing Convention applies, in particular by using or resorting to false or falsified identity or travel documents, residence cards, visas or documents proving compliance with the entry conditions.
h) Que tenha contornado ou tentado contornar as normas aplicáveis em matéria de entrada e de permanência, em território nacional ou no dos Estados membros da União Europeia ou dos Estados onde vigore a Convenção de Aplicação, nomeadamente pela utilização ou recurso a documentos de identidade ou de viagem, títulos de residência, vistos ou documentos comprovativos do cumprimento das condições de entrada falsos ou falsificados.
2. The preceding paragraph is without prejudice to any criminal liability incurred by the foreign national.
2 - O disposto no número anterior não prejudica a responsabilidade criminal em que o estrangeiro haja incorrido.
3. Refugees are subject to the more favourable regime arising from any law or international convention by which the Portuguese State is bound.
3 - Aos refugiados aplica-se o regime mais benéfico resultante de lei ou convenção internacional a que o Estado Português esteja obrigado.
