1. A foreign national detained under Article 146(1) who, during judicial questioning and after being informed of paragraphs 2 and 3, declares an intention to leave national territory and the territory of the Member States of the European Union and of the States in which the Implementing Convention applies may, by order of the competent judge and provided that the foreign national holds the proper documents, be handed over to the custody of the territorially competent security force to be escorted to the border crossing point and removed as soon as possible.
1 - O cidadão estrangeiro detido nos termos do n.º 1 do artigo 146.º que, durante o interrogatório judicial e depois de informado sobre o disposto nos n.os 2 e 3, declare pretender abandonar o território nacional, bem como o território dos Estados-Membros da União Europeia e dos Estados onde vigore a Convenção de Aplicação, pode, por determinação do juiz competente e desde que devidamente documentado, ser entregue à custódia da força de segurança territorialmente competente para efeitos de condução ao posto de fronteira e afastamento no mais curto espaço de tempo possível.
2. A person who declares an intention to be escorted to the border crossing point is banned from entering and staying in national territory and in the territory of the Member States of the European Union and of the States in which the Implementing Convention applies for a period of one year.
2 - O cidadão que declare pretender ser conduzido ao posto de fronteira fica interdito de entrar e de permanecer em território nacional e no território dos Estados membros da União Europeia e dos Estados onde vigore a Convenção de Aplicação pelo prazo de um ano.
