1. The forced removal decision lies within the competence of the National Director of the PSP.
1 - A decisão de afastamento coercivo é da competência do diretor nacional da PSP.
2. The forced removal decision is communicated to the Agency for Integration, Migration and Asylum (AIMA) and notified to the person concerned, stating the grounds for the decision, the right to challenge it in court and the time limit for doing so, and the entry of the person in the Schengen Information System (SIS) or in the national list of inadmissible persons, without prejudice to the rules applicable to the protection of personal data.
2 - A decisão de afastamento coercivo é comunicada à AIMA, IP, e notificada ao respetivo destinatário, com indicação dos seus fundamentos, do direito de impugnação judicial e do respetivo prazo, bem como da sua inscrição no SIS ou na lista nacional de pessoas não admissíveis, sem prejuízo das normas aplicáveis em matéria de proteção de dados pessoais.
3. The forced removal decision must contain:
3 - A decisão de afastamento coercivo contém obrigatoriamente:
b) The legal obligations of the third-country national subject to the forced removal decision;
b) As obrigações legais do nacional do país terceiro sujeito à decisão de afastamento coercivo;
c) The ban on entry into and stay in national territory and the alert for refusal of entry and stay in the territory of the Member States of the European Union and of the States in which the Implementing Convention applies, where applicable, stating the respective periods;
c) A interdição de entrada e de permanência em território nacional e a indicação de recusa de entrada e de permanência no território dos Estados membros da União Europeia e dos Estados onde vigore a Convenção de Aplicação, quando aplicável, com a indicação dos respetivos prazos;
d) An indication of the country to which a foreign national who benefits from the safeguard provided for in Article 143 must not be sent.

4. The procedure is closed and the alerts resulting from the removal are deleted where the decision is not enforced because notification is impossible or because compliance with the duty to return has not been confirmed, provided that twice the period actually set for the entry and stay ban has elapsed since the date on which the decision was issued.
4 - O procedimento é arquivado e as indicações que resultem do afastamento são suprimidas quando a decisão não seja executada por impossibilidade de notificação ou pela não confirmação do cumprimento do dever de regresso, desde que da data da sua prolação decorra o dobro do tempo concretamente determinado para a interdição de entrada e de permanência.
