1. Airport transit may be authorised at the request of the competent authorities of a Member State carrying out the removal of a third-country national, whenever such transit is necessary.
1 - Pode ser autorizado o trânsito aeroportuário a pedido das autoridades competentes de um Estado membro que procedam ao afastamento de um nacional de Estado terceiro, sempre que este seja necessário.
a) The third-country national is charged with a criminal offence or their arrest has been ordered for the purpose of serving a sentence, under the applicable legislation; or
a) O nacional de um Estado terceiro for acusado de infracção penal ou tiver sido ordenada a sua captura para cumprimento de pena, nos termos da legislação aplicável; ou
b) Transit through other States or admission to the country of destination is not feasible; or
b) O trânsito através de outros Estados ou a admissão no país de destino não forem exequíveis; ou
c) The removal measure involves a change of airport in national territory; or
c) A medida de afastamento implicar uma mudança de aeroporto no território nacional; ou
d) It is not possible, for practical reasons, to provide the requested support at a given time; or
d) Não for possível, por razões práticas, prestar numa determinada altura o apoio solicitado; ou
e) The presence of the third-country national in national territory constitutes a threat to public policy, public security or public health, or to the international relations of the Portuguese State.
e) A presença do nacional de um Estado terceiro em território nacional constituir uma ameaça para a ordem pública, a segurança pública ou a saúde pública, ou para as relações internacionais do Estado Português.
3. In the case referred to in point (d) of the preceding paragraph, the requesting Member State shall be informed as soon as possible of a date, as close as possible to the date originally requested, on which, provided the other requirements are met, support for airport transit can be given.
3 - No caso da alínea d) do número anterior, é indicada com a máxima brevidade ao Estado membro requerente uma data, o mais próxima possível da inicialmente solicitada, em que, estando cumpridos os demais requisitos, possa ser dado apoio ao trânsito aeroportuário.
4. Airport transit authorisations already granted may be revoked if facts subsequently come to light which, under paragraph 2, would justify refusing transit.
4 - As autorizações de trânsito aeroportuário já concedidas podem ser revogadas se posteriormente se tornarem conhecidos factos que, nos termos do n.º 2, justifiquem a recusa de trânsito.
5. The PSP shall inform the competent authorities of the requesting Member State, without delay, of the refusal or revocation of the airport transit authorisation under paragraph 2 or the preceding paragraph, or of the impossibility of carrying out the transit for any other reason, stating the grounds for the decision.
5 - A PSP comunica às autoridades competentes do Estado membro requerente, sem demora, a recusa ou revogação da autorização de trânsito aeroportuário, nos termos do n.º 2 ou do número anterior, ou a impossibilidade da sua realização por qualquer outro motivo, fundamentando a decisão.
