1. A foreign national notified of an administrative decision refusing an application for stay or residence, or of an administrative decision cancelling their visa or residence card, must leave national territory within the time limit set for them, of between 20 and 30 days.
1 - O cidadão estrangeiro notificado de decisão administrativa que indefira o pedido de permanência ou de residência, ou da decisão administrativa de cancelamento do respetivo visto ou título de residência, deve abandonar o território nacional no prazo que lhe for fixado, entre 20 e 30 dias.
3. The time limit referred to in paragraph 1 may be extended by order (despacho) of the National Director of the PSP, who may delegate this power, taking into account, in particular, the length of stay, the existence of children attending school and the existence of other family members and social ties; the foreign national is notified of that decision.
3 - O prazo referido no n.º 1 pode ser prorrogado por despacho do diretor nacional da PSP, com faculdade de delegação, tendo em conta, designadamente, a duração da permanência, a existência de filhos que frequentem a escola, a existência de outros membros da família e de laços sociais, sendo o cidadão estrangeiro notificado dessa decisão.
7. The duty to leave is recorded in the UCFE Integrated Information System (SII UCFE) and entered in the Schengen Information System (SIS), with an annotation of the time limit for leaving, as a return alert, for a period of one year.
7 - O dever de abandono é registado no SII UCFE e é introduzido no SIS com averbamento do prazo para o abandono, enquanto indicação de regresso, por um período de um ano.
8. For the purposes of the preceding paragraph, the alert is deleted immediately if the foreign national brings the illegal stay to an end, in particular where the foreign national confirms having left national territory and the territory of the States in which the Implementing Convention applies, or where the Agency for Integration, Migration and Asylum (AIMA), the PSP or the National Republican Guard (GNR) become aware of this by any means or through notification by another Member State of the European Union or a State in which the Implementing Convention applies.
8 - No âmbito do disposto no número anterior, a indicação é imediatamente eliminada se o cidadão estrangeiro fizer cessar a permanência ilegal, nomeadamente quando o próprio confirmar que abandonou o território nacional e o dos Estados onde vigore a Convenção de Aplicação, ou quando a AIMA, I. P., a PSP ou a GNR tenham conhecimento por qualquer meio ou em virtude da sua comunicação por outro Estado-Membro da União Europeia ou Estado onde vigore a Convenção de Aplicação.
