1. Rural property and the urban property or part of urban property intended for the own permanent residence of the taxpayer or of the taxpayer’s household, and actually used for that purpose, are exempt from municipal property tax, provided that the household’s total gross income does not exceed 2.3 times the amount of 14 times the Social Support Index (IAS) and the overall taxable property value of all the rural and urban property belonging to the household does not exceed 10 times the amount of 14 times the IAS.

2. For the purposes of the preceding paragraph, the household’s income is that of the year preceding the year to which the exemption relates.

#

3. The income referred to in paragraph 1 is determined individually whenever, in the year to which the exemption relates, the taxpayer no longer forms part of the household referred to in the preceding paragraph.

#

4. The exemptions referred to in paragraph 1 are automatic, do not cover property belonging to non-resident taxpayers, and are recognised ex officio and annually by the Tax and Customs Authority (AT) from the date of acquisition of the property or the date on which the relevant conditions are met.

#

5. Failure by the taxpayer or by the members of the taxpayer’s household to comply on time with their reporting obligations for IRS and IMI purposes means that the exemptions provided for in paragraph 1 are not granted.

#

6. The exemption referred to in paragraph 1 covers storerooms, pantries and garages, even if physically separate, provided that they form part of the same building or residential complex and are used exclusively by the owner or the owner’s household as an adjunct to the exempt dwelling.

#

7. In the case of co-ownership, the overall taxable property value referred to in paragraph 1 is the value proportionally corresponding to the share of the taxpayer and of the other members of the taxpayer’s household.

#

8. For the purposes of this article, the urban property or part of urban property used as the own permanent residence of the taxpayer or of the taxpayer’s household is the property in which their tax domicile is established.

#

9. Without prejudice to the preceding paragraph, a taxpayer who, on 31 December of the year to which the tax relates, is living in a care home for the elderly, in a health institution or at the tax domicile of relatives by blood or by marriage in the direct line or in the collateral line up to the 4th degree may benefit from the exemption provided for in this article by proving to the Tax and Customs Authority, by that date, that the urban property or part of urban property in question was previously their own permanent residence.

#

10. Where the taxpayer is an undivided estate, in respect of urban property actually used as the permanent residence of the heirs, the exemption applies to the share of those heirs who are identified in the property register and in respect of whom, or of whose households, the conditions for the exemption are met.

#

11. For the purposes of the preceding paragraph, the overall taxable property value belonging to the heir or to the heir’s household includes the value corresponding to the heir’s share in the estate property used as the heir’s permanent residence.
