1. Without prejudice to other prohibitions provided for by law, until the declaration and rectification obligations laid down in this regime have been complied with, the entities concerned are prohibited from:
1 - Sem prejuízo de outras proibições legalmente previstas, enquanto não se verificar o cumprimento das obrigações declarativas e de retificação previstas no presente regime, é vedado às respetivas entidades:
a) Distributing profits for the financial year or paying interim dividends (advances on profits) during the financial year;
a) Distribuir lucros do exercício ou fazer adiantamentos sobre lucros no decurso do exercício;
b) Entering into contracts for supplies, public works or the acquisition of services and goods with the State, the autonomous regions, public institutes, local authorities and private social solidarity institutions mainly financed by the State Budget, or renewing the term of existing contracts;
b) Celebrar contratos de fornecimentos, empreitadas de obras públicas ou aquisição de serviços e bens com o Estado, regiões autónomas, institutos públicos, autarquias locais e instituições particulares de solidariedade social maioritariamente financiadas pelo Orçamento do Estado, bem como renovar o prazo dos contratos já existentes;
d) Admitting to trading on a regulated market financial instruments representing their share capital or convertible into it;
d) Admitir à negociação em mercado regulamentado instrumentos financeiros representativos do seu capital social ou nele convertíveis;
e) Launching public offers for the distribution of any financial instruments issued by them;
e) Lançar ofertas públicas de distribuição de quaisquer instrumentos financeiros por si emitidos;
f) Benefiting from support from the European structural and investment funds and from public funds;
f) Beneficiar dos apoios de fundos europeus estruturais e de investimento e públicos;
g) Taking part as a party in any transaction whose object is the transfer of ownership, whether for consideration or free of charge, or the creation, acquisition or disposal of any other rights in rem of enjoyment or security over any immovable property.
g) Intervir como parte em qualquer negócio que tenha por objeto a transmissão da propriedade, a título oneroso ou gratuito, ou a constituição, aquisição ou alienação de quaisquer outros direitos reais de gozo ou de garantia sobre quaisquer bens imóveis.
2. Failure to comply with the declaration obligations, or failure to submit a justification exempting the entity from them, after the expiry of the period laid down for that purpose under Article 26(2), shall result in the publication in the RCBE, on the website provided for in Article 19, of the non-compliance by the entity subject to the RCBE.
2 - A falta de cumprimento das obrigações declarativas ou a falta de apresentação de justificação que as dispense após o decurso do prazo estipulado para o efeito, nos termos do n.º 2 do artigo 26.º, implica a publicitação no RCBE da situação de incumprimento pela entidade sujeita na página eletrónica prevista no artigo 19.º
3. In order to ensure the publication referred to in the preceding paragraph, the competent authorities shall promptly and fully provide such cooperation as IRN, I. P., may request of them.
3 - Com vista a assegurar a publicitação a que se refere o número anterior, as autoridades competentes prestam, de forma pronta e cabal, a colaboração que lhes for requerida pelo IRN, I. P.
4. For the purposes of points (a) to (g) of paragraph 1, proof of compliance with the declaration obligations shall be provided by electronic consultation of the RCBE.
4 - Para efeitos do disposto nas alíneas a) a g) do n.º 1, a comprovação do cumprimento das obrigações declarativas efetua-se mediante consulta eletrónica ao RCBE.
5. For the purposes of point (g) of paragraph 1, the person formalising the transaction (titulador) shall consult the RCBE and shall record that circumstance in the document refusing formalisation.
5 - Para o efeito do disposto na alínea g) do n.º 1, o titulador procede à consulta do RCBE, fazendo constar do documento de recusa de titulação essa circunstância.
