1. The following information on the beneficial owners of entities that are subject to the RCBE under Article 3 shall be made available on a website to anyone who demonstrates a legitimate interest in accessing the information:
1 - É disponibilizada, em página eletrónica, a quem demonstre ter um interesse legítimo no acesso à informação, a seguinte informação sobre os beneficiários efetivos das entidades que, de acordo com o disposto no artigo 3.º, estejam sujeitas ao RCBE:
a) As regards the entity: the legal person identification number (NIPC) or tax identification number (NIF) assigned in Portugal by the competent authorities and, in the case of a foreign entity, the tax identification number issued by the competent authority of its jurisdiction; the business name or corporate name; the legal form; the registered office; the economic activity code (CAE); the Legal Entity Identifier, where applicable; and the institutional email address;
a) Relativamente à entidade, o NIPC ou o NIF atribuído em Portugal pelas autoridades competentes e, tratando-se de entidade estrangeira, o NIF emitido pela autoridade competente da respetiva jurisdição, a firma ou denominação, a natureza jurídica, a sede, o CAE, o identificador único de entidades jurídicas (Legal Entity Identifier), quando aplicável, e o endereço eletrónico institucional;
b) As regards the beneficial owners: the name, the month and year of birth, the nationality, the country of residence and the economic interest held.
b) Relativamente aos beneficiários efetivos, o nome, o mês e o ano do nascimento, a nacionalidade, o país da residência e o interesse económico detido.
3. The making available of information referred to in paragraph 1, as well as the criteria for searching RCBE information, shall be regulated by order (portaria) of the members of the Government responsible for finance and justice.
3 - A disponibilização referida no n.º 1, bem como os critérios de pesquisa da informação do RCBE, são regulados em portaria dos membros do Governo responsáveis pelas áreas das finanças e da justiça.
4. All access shall be logged for system audit purposes for a period of five years, including the legitimate interest invoked.
4 - Todos os acessos efetuados devem ficar registados para fins de auditoria ao sistema pelo prazo de cinco anos, incluindo o interesse legítimo invocado.
5. Information on the beneficial owners of entities that are subject to the RCBE under Article 3 may also be made available through the digital wallet service, in a manner to be laid down in specific legislation.
5 - A informação sobre os beneficiários efetivos das entidades que, de acordo com o disposto no artigo 3.º, estejam sujeitas ao RCBE, pode ainda ser disponibilizada através do serviço de carteira digital, em moldes a definir em diploma próprio.
Access conditional on demonstrating a legitimate interest, the closed list of entity and beneficial owner data in points (a) and (b), the repeal of paragraph 2, and the five-year logging of access including the legitimate interest invoked are retained.
