1. Access to information on the beneficial owner may be wholly or partly restricted where it is found that its disclosure is liable to expose the person so identified to the risk of fraud, threats, coercion, harassment, kidnapping, extortion or other forms of violence or intimidation, or where the beneficial owner is a minor or legally incapacitated.
1 - O acesso à informação sobre o beneficiário efetivo pode ser total ou parcialmente limitado quando se verifique que a sua divulgação é suscetível de expor a pessoa assim identificada ao risco de fraude, ameaça, coação, perseguição, rapto, extorsão, ou outras formas de violência ou intimidação, ou se o beneficiário efetivo for menor ou incapaz.
2. The situation shall be assessed case by case by the president of the executive board of IRN, I. P., preceded where necessary by a risk assessment by the competent authorities, following a reasoned application by the declarant, by the person indicated as beneficial owner or by that person’s legal representative, or following an indication from any entity pursuing criminal investigation purposes.
2 - A situação é avaliada caso a caso pelo presidente do conselho diretivo do IRN, I. P., se necessário precedida de avaliação de risco pelas autoridades competentes, na sequência de requerimento fundamentado do declarante, da pessoa indicada como beneficiário efetivo ou do seu representante legal, ou de indicação de qualquer entidade que prossiga fins de investigação criminal.
3. The power to decide on the restriction of access to information provided for in this Article may be delegated in accordance with the law.
3 - A competência para decidir sobre a limitação do acesso à informação prevista no presente artigo pode ser delegada nos termos legais.
4. The restriction provided for in the preceding paragraphs shall not apply to access by credit institutions, other payment service providers and financial companies in compliance with the preventive duties laid down in Article 11 of Law No. 83/2017 of 18 August, by registrars and registry officers, or by the authorities referred to in the preceding Article.
4 - A limitação prevista nos números anteriores não é aplicável ao acesso feito pelas instituições de crédito, outros prestadores de serviços de pagamento e sociedades financeiras, no cumprimento dos deveres preventivos previstos no artigo 11.º da Lei n.º 83/2017, de 18 de agosto, pelos conservadores e oficiais de registos, nem pelas autoridades a que se refere o artigo anterior.
5. The applicant for the restriction of access and the beneficial owner themselves or their legal representative shall have standing to withdraw the application made.
5 - Têm legitimidade para desistir do pedido formulado o requerente da limitação de acesso e o próprio beneficiário efetivo ou o seu representante legal.
6. Where none of the grounds provided for in this Article has been invoked, the rejection of the application shall be notified to the applicant without a prior hearing.

7. The procedure shall be conducted electronically, under terms to be laid down by order (portaria) of the members of the Government responsible for finance and justice.
