1. The first initial declaration concerning the beneficial owner must be made within the period to be set by order (portaria) of the members of the Government responsible for finance and justice.
1 - A primeira declaração inicial relativa ao beneficiário efetivo deve ser efetuada no prazo a definir por portaria dos membros do Governo responsáveis pelas áreas das finanças e da justiça.
2. In order to ensure compliance with the preceding paragraph:
2 - Com vista a assegurar o cumprimento do disposto no número anterior:
a) the information contained in the Central File of Legal Persons concerning the entities falling within Article 3(1) of the Legal Regime of the RCBE, approved in the annex to this Law, is communicated to the RCBE together with their respective identification details;
a) A informação constante no Ficheiro Central de Pessoas Coletivas respeitante às entidades enquadráveis no n.º 1 do artigo 3.º do Regime Jurídico do RCBE, aprovado em anexo à presente lei, é comunicada ao RCBE com os respetivos elementos de identificação;
b) the Tax and Customs Authority (AT) communicates to the RCBE the identification of the entities falling within Article 3(2) of the Legal Regime of the RCBE, approved in the annex to this Law, that have already been assigned a tax identification number;
b) A Autoridade Tributária e Aduaneira (AT) comunica ao RCBE a identificação das entidades enquadráveis no disposto no n.º 2 do artigo 3.º do Regime Jurídico do RCBE, aprovado em anexo à presente lei, que já tenham número de identificação fiscal atribuído;
c) obliged entities communicate to their respective sectoral authorities the identification of the entities to which they provide the services referred to in Article 3(2)(a) of the Legal Regime of the RCBE, approved in the annex to this Law, or with which they maintain the business relationships referred to in points (c) and (d) of that paragraph.
c) As entidades obrigadas comunicam às respetivas autoridades setoriais a identificação das entidades às quais prestem os serviços referidos na alínea a) do n.º 2 do artigo 3.º do Regime Jurídico do RCBE, aprovado em anexo à presente lei, ou com as quais mantenham as relações de negócio a que se referem as alíneas c) e d) do mesmo número.
3. The communications referred to in points (a) and (b) of the preceding paragraph are made automatically and electronically, within the period set in the order referred to in paragraph 1.
3 - As comunicações referidas nas alíneas a) e b) do número anterior são efetuadas automática e eletronicamente, no prazo fixado na portaria prevista no n.º 1.
4. In the case provided for in paragraph 2(c), the sectoral authorities confirm the status as an entity subject to the register and transmit the information to the RCBE electronically.
4 - No caso previsto na alínea c) do n.º 2, as autoridades setoriais confirmam a qualidade de entidade sujeita e transmitem a informação ao RCBE, por via eletrónica.
5. The consequences laid down in points (a) to (g) of Article 37(1) of the Legal Regime of the RCBE, approved in the annex to this Law, arising from failure to comply with the declaration obligations, are relevant only to contracts, acts or procedures entered into, performed or concluded on or after the date set by order of the members of the Government responsible for finance and justice for electronic consultation of the RCBE.
5 - As consequências emergentes do incumprimento das obrigações declarativas previstas nas alíneas a) a g) do n.º 1 do artigo 37.º do Regime Jurídico do RCBE, aprovado em anexo à presente lei, apenas relevam quanto a contratos, atos ou procedimentos celebrados, praticados ou concluídos a partir da data fixada por portaria dos membros do Governo responsáveis pelas áreas das finanças e da justiça para a consulta eletrónica ao RCBE.
The ministerial-order deadlines, the three communication channels in points (a) to (c), and the limitation in paragraph 5 to contracts, acts or procedures from the date set for electronic consultation (Article 37(1)(a) to (g) of the annex) are retained.
