1. The Agency for Integration, Migration and Asylum (AIMA) shall immediately inform the contact point of the relevant Member State of the European Union or State Party to the Convention implementing the Schengen Agreement of the receipt of any reimbursement request addressed to it in respect of the enforcement of a removal decision taken by a competent national authority.

P., informa de imediato o ponto de contacto do respetivo Estado-Membro da União Europeia ou de Estado Parte na Convenção de Aplicação do Acordo de Schengen da receção de pedido de reembolso que lhe tenha sido dirigido por motivo de execução de uma decisão de afastamento proferida por autoridade competente nacional.
2. The assessment of the reimbursement request shall take into account the date of the expulsion decision, the date of its enforcement and the nature of the expenses claimed.
2 - A apreciação do pedido de reembolso tem em conta a data da decisão de expulsão, a data da respectiva execução e a natureza das despesas apresentadas.
3. AIMA shall reply to the reimbursement request within a maximum of three months and, in the event of refusal, shall state the grounds for it.
3 - A AIMA, I. P., responde ao pedido de reembolso no prazo máximo de três meses e, em caso de recusa, com a indicação dos respetivos fundamentos.
a) The expulsion decision was enforced more than four years after it was taken;
a) A execução da decisão de expulsão ter tido lugar mais de quatro anos após ter sido proferida;
b) The reimbursement request was submitted more than one year after enforcement of the decision;
b) O pedido de reembolso ter sido apresentado mais de um ano após a execução da decisão;
c) The expulsion decision was taken before 28 February 2004;
c) A decisão de expulsão ter sido proferida em data anterior a 28 de Fevereiro de 2004;
d) The expenses claimed are not considered eligible under the following Article;
d) As despesas apresentadas não serem consideradas elegíveis nos termos do artigo seguinte;
e) The reimbursement request was not submitted in writing or was not accompanied by documents proving the eligible expenses.
e) O pedido de reembolso não ter sido apresentado por escrito ou não ter sido acompanhado dos documentos comprovativos das despesas elegíveis.
5. Where payment is accepted, AIMA shall make the payment within a maximum of three months from the date of its reply to the reimbursement request.
5 - Em caso de aceitação do pagamento, a AIMA, I. P., efetua o pagamento num prazo máximo de três meses a contar da data de resposta ao pedido de reembolso.
