1. Where the taxpayer or the head of the tax office disagrees with the result of the direct valuation of rural property, they may respectively request or initiate a second valuation within 30 days from the date on which the former was notified.

#

2. The second valuation is carried out in compliance with this Code by a committee with the composition and on the terms referred to in Article 74.

#

3. If the second valuation is requested by the taxpayer, failure by the taxpayer or the taxpayer’s representative to appear makes the result of the first valuation final, unless the absence is justified within eight days, in which case a postponement is allowed.

#

4. Whenever the second valuation is initiated by the head of the tax office, the taxpayer must be notified to state, within 20 days, whether they wish to sit on the committee or to appoint their representative.

#

5. In the case provided for in the preceding paragraph, if the taxpayer does not state that they wish to sit on the committee or does not designate their representative within the time limit set there or, having designated one, the representative fails to appear, the power to appoint the representative passes to the head of the tax office, who appoints a regional valuer.

#

6. In the case referred to in paragraph 4, the final part of paragraph 3 applies to failure by the taxpayer or the taxpayer’s representative to appear.

#

7. Where the second valuation is requested by the taxpayers and, as a result, the taxable property value (VPT) remains the same or increases, the costs of the valuation are reimbursed by them to the Directorate-General for Taxation (DGCI).
