Chapter VI · Special provisions

Article 27 Entitlement to benefits of the Convention

Artigo 27.º · Direito aos benefícios da Convenção

Convenção Portugal–Suíça · signed 26 September 1974 · in force 17 December 1975 · English: our translation

Once the MLI takes effect for this Convention (see the Preamble), the principal purpose test of Article 7(1) of the MLI is expected to replace paragraph 3 (both States notified it under Article 7(17)(a); Switzerland identifies it as “Art. 27, par. 3”): “Notwithstanding any provisions of the Convention, a benefit under the Convention shall not be granted in respect of an item of income or capital if it is reasonable to conclude, having regard to all relevant facts and circumstances, that obtaining that benefit was one of the principal purposes of any arrangement or transaction that resulted directly or indirectly in that benefit, unless it is established that granting that benefit in these circumstances would be in accordance with the object and purpose of the relevant provisions of the Convention.” Neither State chose the simplified limitation-on-benefits provision.

Applying the law

Treaty relief between Portugal and Switzerland, claimed correctly

Treaty rates are not automatic in Portugal: the recipient must give the payer a form certified by its own tax authority before the tax is due, or claim a refund afterwards. We check which article applies, the rate and the paperwork.
