1. In the case of a resident of Spain, double taxation shall be avoided, in accordance with the applicable provisions of Spanish law (provided that they do not conflict with the general principles laid down in this paragraph), as follows:

#

a) Where a resident of Spain derives income which, in accordance with the provisions of this Convention, may be taxed in Portugal, Spain shall allow as a deduction from the tax on the income of that resident an amount equal to the tax actually paid in Portugal.

#

Such deduction shall not, however, exceed that part of the tax, as computed before the deduction is given, which is attributable to the income which may be taxed in Portugal;

A importância deduzida não poderá, contudo, exceder a fracção do imposto, calculado antes da dedução, correspondente aos rendimentos que podem ser tributados em Portugal;

#

b) In the case of dividends paid by a company which is a resident of Portugal to a company which is a resident of Spain and which holds directly at least 25% of the capital of the company paying the dividends, there shall be taken into account in determining the deduction, in addition to the amount deductible under subparagraph a) of this paragraph, the tax actually paid by the first-mentioned company in respect of the profits out of which the dividends are paid, in the amount corresponding to such dividends, provided that that amount is included, for this purpose, in the tax base of the company receiving the dividends.

#

Such deduction, together with the deduction applicable in respect of the dividends under subparagraph a) of this paragraph, shall not exceed that part of the income tax, as computed before the deduction is given, which is attributable to the income taxed in Portugal.

#

For the purposes of applying this subparagraph, the holding in the company paying the dividends must be at least 25% and must have been held without interruption during the two years preceding the day on which the dividends are paid.

#

2. In the case of a resident of Portugal, double taxation shall be avoided, in accordance with the applicable provisions of Portuguese law (provided that they do not conflict with the general principles laid down in this paragraph), as follows:

#

a) Where a resident of Portugal derives income which, in accordance with the provisions of this Convention, may be taxed in Spain, Portugal shall allow as a deduction from the tax on the income of that resident an amount equal to the tax paid in Spain.

#

Such deduction shall not, however, exceed that part of the income tax, as computed before the deduction is given, which is attributable to the income which may be taxed in Spain;

A importância deduzida não poderá, contudo, exceder a fracção do imposto sobre o rendimento, calculado antes da dedução, correspondente aos rendimentos que podem ser tributados em Espanha;

#

b) Where a company which is a resident of Portugal receives dividends from a company which is a resident of Spain in which the former holds directly a participation of not less than 25% of the capital, Portugal shall deduct, for the purpose of determining the taxable profit subject to corporate income tax, 95% of those dividends included in the tax base, under the terms and conditions laid down in Portuguese law.

#

3. Where in accordance with any provision of this Convention income derived by a resident of a Contracting State is exempt from tax in that State, such State may nevertheless, in calculating the amount of tax on the remaining income of such resident, take into account the exempted income.

Applying the law

Treaty relief between Portugal and Spain, claimed correctly

Treaty rates are not automatic in Portugal: the recipient must give the payer a form certified by its own tax authority before the tax is due, or claim a refund afterwards. We check which article applies, the rate and the paperwork.
