1. If not all the shares intended for the public are subscribed by it and paragraph 3 of this Article does not apply, the promoters must apply for cancellation of the provisional registration and publish a notice informing the subscribers that they must withdraw their contributions. A second notice must be published once one month has elapsed if, in the meantime, not all the contributions have been withdrawn.
1 - Não sendo subscritas pelo público todas as acções a ele destinadas e não sendo aplicável o disposto no n.º 3 deste artigo, devem os promotores requerer o cancelamento do registo provisório e publicar um anúncio em que informem os subscritores de que devem levantar as suas entradas. Segundo anúncio deve ser publicado, decorrido um mês, se, entretanto, não tiverem sido levantadas todas as entradas.
2. The credit institution at which the account referred to in Article 277(3) was opened shall refund the sums deposited only on presentation of the subscription and deposit document and after the provisional registration has been cancelled or has lapsed.

3. The programme of the offer of shares for public subscription may specify that, in the event of incomplete subscription, the constituent meeting may resolve to incorporate the company, provided that at least three quarters of the shares intended for the public have been subscribed.
3 - O programa da oferta de acções à subscrição pública pode especificar que, no caso de subscrição incompleta, é facultado à assembleia constitutiva deliberar a constituição da sociedade, contanto que tenham sido subscritos pelos menos três quartos das acções destinadas ao público.
4. If the company is not incorporated, all expenses incurred are borne by the promoters.
