1. The lodging of an administrative appeal or the bringing of a judicial challenge must be noted immediately, following the note of the refusal or the provisional registration.
1 - A interposição de recurso hierárquico ou a impugnação judicial devem ser imediatamente anotadas, a seguir à anotação da recusa ou ao registo provisório.
2. The dismissal or withdrawal of the administrative appeal or judicial challenge shall also be noted, as shall, where applicable, the abandonment of the proceedings or the proceedings being at a standstill for more than 30 days owing to the claimant’s inaction.
2 - São ainda anotadas a improcedência ou a desistência do recurso hierárquico ou da impugnação judicial, bem como, sendo caso disso, a deserção da instância ou a paragem do processo durante mais de 30 dias por inércia do autor.
3. Upon the bringing of the action or the lodging of the administrative appeal, the period after which the provisional registration lapses shall be suspended until the facts referred to in the preceding paragraph are noted against it.
3 - Com a propositura da acção ou a interposição de recurso hierárquico fica suspenso o prazo de caducidade do registo provisório até lhe serem anotados os factos referidos no número anterior.
4. Once a final decision has been given holding that the refusal to carry out the act as applied for cannot stand, the refused registration must be made on the basis of the corresponding filing, or the provisional registration must be converted ex officio.
4 - Proferida decisão final que julgue insubsistente a recusa da prática do acto nos termos requeridos, deve ser efectuado o registo recusado, com base na apresentação correspondente, ou convertido oficiosamente o registo provisório.
The immediate noting of the appeal or challenge, the events to be noted, the suspension of the lapse period of the provisional registration and the making or ex officio conversion of the registration after a favourable final decision are retained.
