1. Where withholding tax constitutes a payment on account of tax and the entity required to withhold it has failed to do so, in whole or in part, or, having done so, has failed to pay over the tax or has paid it over late, that entity owes compensatory interest on the relevant amounts, calculated, in the latter case, from the day following that on which they should have been paid over until the date of payment or assessment and, in the former case, from that same date until the end of the period for the taxpayer to submit the periodic income tax return, without prejudice to any liability that may arise in the case.

2. Where withholding tax is final, compensatory interest is due from the entity responsible for withholding it on the amounts not withheld, or withheld but not paid over within the legal time limit, calculated from the day following that on which they should have been paid over until the date of payment or assessment.

3. Article 35 of the General Tax Law applies to the compensatory interest referred to in the preceding paragraphs.

#

4. In the case of the withholdings covered by paragraph 1, the entity paying the income is secondarily liable for payment of the tax subsequently found to be due from the taxpayer receiving the income, up to the difference between the tax that was deducted and the tax that should have been deducted.

5. Where withholding tax is final, the recipients of the income are secondarily liable for payment of the tax, in respect of the difference mentioned in the preceding paragraph.

What we checked in this article

The distinction between withholding on account and final withholding, the start and end dates of compensatory interest in each case, the secondary liability of the payer and of the recipient, and the 30-day period for separate payment of interest are retained.
