1. The list of highly qualified professions for the purposes of Article 58-A(1)(c) of the EBF is approved in Annex I to this order, of which it forms an integral part.
1 - É aprovada no anexo i à presente portaria, da qual faz parte integrante, a lista de profissões altamente qualificadas para efeitos do disposto na alínea c) do n.º 1 do artigo 58.º-A do EBF.
2. Workers in the professional activities referred to in the preceding paragraph must hold, as a minimum:

a) Level 8 of the European Qualifications Framework or level 8 of the International Standard Classification of Education (ISCED); or
a) Do nível 8 do Quadro Europeu de Qualificações, ou do nível 8 da Classificação Internacional Tipo da Educação (ISCED); ou
b) Level 6 of the European Qualifications Framework or level 6 of the International Standard Classification of Education (ISCED), together with three years of duly documented professional experience.

3. For the purposes of Article 58-A(1)(c)(i) of the EBF, the positions of directors (administradores), managers (gerentes) and general managers of companies with relevant investments in the financial year in which the person takes up their duties or in the five preceding financial years, that benefit or have benefited from the tax regime for investment support under Chapter III of the Investment Tax Code, are also deemed to be highly qualified professions.
3 - Consideram-se, ainda, profissões altamente qualificadas para efeitos da subalínea i) da alínea c) do n.º 1 do artigo 58.º-A do EBF, os cargos de administradores, gerentes e diretores-gerais de empresas com aplicações relevantes no exercício do início de funções ou nos cinco exercícios anteriores, que beneficiem ou tenham beneficiado do regime fiscal de apoio ao investimento, nos termos do capítulo iii do Código Fiscal do Investimento.
4. In the case of regulated professions, the taxpayer must also prove that they meet the requirements of the other applicable legislation.
4 - No caso de profissões regulamentadas, o sujeito passivo deve igualmente comprovar que cumpre os requisitos da demais legislação aplicável.

In case of doubt as to the scope and extent of the activities on the list, regard must be had to the codes of the Portuguese Classification of Occupations annexed to Resolution (Deliberação) No. 967/2010 of the Statistics Council (Conselho Superior de Estatística) of 5 May 2010, published in the Diário da República, 2nd series, No. 106, of 1 June 2010, and to the related explanatory notes.
5 - Em caso de dúvidas quanto ao âmbito e ao alcance das atividades constantes da lista deve atender-se aos códigos da Classificação Portuguesa das Profissões anexa à Deliberação n.º 967/2010, do Conselho Superior de Estatística, de 5 de maio de 2010, publicada no Diário da República, 2.ª série, n.º 106, de 1 de junho de 2010, bem como às respetivas notas explicativas.
