The costs provided for in the preceding article are determined in accordance with the following rules:
A determinação dos encargos prevista no artigo anterior obedece às seguintes regras:
a) The amount of the costs referred to in Article 24(1)(a) and (b) is set according to local practice, taking into account the cost prices of the operating inputs;
a) O montante dos encargos referidos nas alíneas a) e b) do n.º 1 do artigo 24.º é fixado segundo os usos locais, tendo em conta os preços de custo dos factores de exploração;
b) Cultivation costs are those usually corresponding to cultivation proper, to the guarding and surveillance of the products, to harvesting and transport to the farm outbuildings, to the insurance of the crops and of the stored products and, for products not marketable in kind, to the cost of the technological operations needed to bring them to the first stage at which they become marketable, including in all cases the costs of maintenance and replacement of the fixed operating capital;
b) As despesas de cultura são as habitualmente correspondentes à cultura propriamente dita, à guarda e vigilância dos produtos, à colheita e transporte até às dependências rurais, ao seguro das culturas e dos produtos armazenados e, para os produtos não comercializáveis em natureza, ao encargo das operações tecnológicas necessárias para os levar até ao primeiro estádio em que se tornem comercializáveis, compreendidas em todos os casos as despesas de conservação e reintegração do capital fixo de exploração;
c) The insurance premium is calculated using the current tables of insurance companies;
c) O prémio de seguro é calculado pelas tabelas correntes das companhias de seguros;
d) The costs of preserving produce comprise those relating to storage and to the treatment needed to prevent deterioration;
d) As despesas de conservação dos géneros compreendem as relativas à armazenagem e ao tratamento necessário para evitar a deterioração;
e) The costs of transport to the markets are calculated by reference to the nearest markets and only for products which, according to local practice, can be traded only in those places;
e) As despesas de transporte para os mercados calculam-se com referência aos mais próximos e apenas quanto aos produtos que, segundo os usos locais, só naqueles lugares sejam negociáveis;
f) The costs of replacement of plantations are determined either by the average number of plants to be renewed each year or by the capitalisation annuity of the cost of first establishing the crop, which is the cost of planting plus the negative balances of the operation up to the first year with a positive balance, all carried forward to that same year;
f) As despesas de reintegração das plantações determinam-se quer pelo número médio de plantas a renovar anualmente, quer pela anuidade de capitalização da despesa do primeiro estabelecimento da cultura, que é o custo da plantação acrescido dos saldos negativos da exploração até ao primeiro ano de saldo positivo e tudo reportado a este mesmo ano;
g) The costs of maintenance and replacement relating to land improvements not taken into account in the preceding points are those needed to keep the land in a normal state of cultivation;
g) As despesas de conservação e reintegração relativas a melhoramentos fundiários não consideradas nos números anteriores são as necessárias para manter os terrenos em estado normal de cultura;
h) The costs relating to constructions serving as farm outbuildings are allocated to all crops which, according to local practice, require them and must be calculated on the basis of the average cost of maintenance and replacement of the constructions, by comparison with those currently in use;
h) As despesas relativas a construções que funcionem como dependências agrícolas são imputadas a todas as culturas que, segundo os usos locais, delas careçam e devem calcular-se pelo encargo médio da conservação e reintegração das construções, servindo de confronto as que estiverem sendo utilizadas;
i) General operating expenses comprise other expenses not covered by the preceding points, in particular administration and management expenses, calculated according to local practice, and must be expressed as a percentage of the total of the other expenses, which may not exceed 8%;
i) As despesas gerais de exploração compreendem outras despesas não abrangidas nos números anteriores, nomeadamente as de administração e direcção, calculadas segundo os seus usos locais, devendo ser expressas numa percentagem do total das restantes despesas, a qual não pode exceder 8%;.
j) The interest rate on the operating capital is set by reference to the 12-month EURIBOR rate, increased by 30%.
j) A taxa de juro do capital de exploração tem por referência a taxa EURIBOR, a 12 meses, majorada em 30%.
The cross-reference to Article 24(1)(a) and (b), the 8% cap on general operating expenses and the interest rate of 12-month EURIBOR plus 30% are retained.
