1. Acquisitions of property for resale are exempt from IMT, under the terms of the following paragraph, provided that it is established that the declaration provided for in Article 112 of the Personal Income Tax Code (IRS) or in Article 109(1)(a) of the Corporate Income Tax Code (IRC), as applicable, relating to the carrying on of the activity of purchaser of property for resale, was submitted before the acquisition.

2. The exemption provided for in the preceding paragraph is without prejudice to the assessment and payment of the tax under the general rules, unless it is recognised that the acquirer normally and habitually carries on the activity of purchaser of property for resale.

3. For the purposes of the final part of the preceding paragraph, the taxpayer is deemed to carry on the activity normally and habitually where they prove that they carried it on in the two preceding years by means of a certificate obtained from the Tax Portal (Portal das Finanças), where that certificate states that, in each of the two preceding years, properties previously acquired for that purpose were resold.

4. Where the property has been resold, other than again for resale, within one year, and tax has been paid, the tax shall be cancelled by the head of the tax office at the request of the interested party, accompanied by a document evidencing the transaction, this being treated as a supervening fact under and for the purposes of Article 70(4) of the Code of Tax Procedure and Process.
