a) Supplies of goods dispatched or transported outside the Community by the vendor or by a third party on the vendor’s behalf;
a) As transmissões de bens expedidos ou transportados para fora da Comunidade pelo vendedor ou por um terceiro por conta deste;
b) Supplies of goods dispatched or transported outside the Community by an acquirer who is not resident or established in the national territory, or by a third party on the acquirer’s behalf, even where, before being dispatched or transported, the goods undergo repair, processing, adaptation or any other work within the country, carried out by third parties acting on behalf of the acquirer, with the exception of goods for the equipping or supplying of sports and pleasure boats, touring aircraft or any other means of transport for private use, and of goods carried in the personal luggage of travellers who are domiciled or habitually resident in another Member State;
b) As transmissões de bens expedidos ou transportados para fora da Comunidade por um adquirente sem residência ou estabelecimento em território nacional ou por um terceiro por conta deste, ainda que, antes da sua expedição ou transporte, sofram no interior do País uma reparação, uma transformação, uma adaptação ou qualquer outro trabalho, efectuado por terceiros agindo por conta do adquirente, com excepção dos bens destinados ao equipamento ou abastecimento de barcos desportivos e de recreio, de aviões de turismo ou de qualquer outro meio de transporte de uso privado e dos bens transportados nas bagagens pessoais dos viajantes com domicílio ou residência habitual em outro Estado membro;
c) Supplies of services consisting of work on movable property acquired or imported for the purpose of undergoing such work in the national territory and then dispatched or transported outside the Community by the person who supplied the services, by the recipient of the services who is not established in the national territory, or by a third party on behalf of either of them;
c) As prestações de serviços que consistam em trabalhos realizados sobre bens móveis, adquiridos ou importados para serem objecto de tais trabalhos em território nacional e em seguida expedidos ou transportados para fora da Comunidade por quem os prestou, pelo seu destinatário não estabelecido em território nacional ou por um terceiro por conta destes;
d) Supplies of stores loaded on board vessels used for navigation on the high seas and carrying passengers for reward or used for a commercial, industrial or fishing activity;
d) As transmissões de bens de abastecimento postos a bordo das embarcações afectas à navegação marítima em alto mar e que assegurem o transporte remunerado de passageiros ou o exercício de uma actividade comercial, industrial ou de pesca;
e) Supplies of stores loaded on board rescue, sea-assistance and coastal fishing vessels, with the exception, in the case of the latter, of on-board provisions;
e) As transmissões de bens de abastecimento postos a bordo das embarcações de salvamento, assistência marítima e pesca costeira, com excepção, em relação a estas últimas, das provisões de bordo;
f) The supply, conversion, repair, maintenance, construction, chartering and hiring of vessels used for the activities referred to in points (d) and (e), and the supply, hiring, repair and upkeep of objects, including fishing equipment, incorporated in those vessels or used for their operation;
f) As transmissões, transformações, reparações, operações de manutenção, construção, frete e aluguer de embarcações afectas às actividades a que se referem as alíneas d) e e), assim como as transmissões, aluguer, reparação e conservação dos objectos, incluindo o equipamento de pesca, incorporados nas referidas embarcações ou que sejam utilizados para a sua exploração;
g) The supply, conversion, repair, maintenance, chartering and hiring of aircraft used by airlines operating chiefly in international traffic, and the supply, repair, maintenance and hiring of objects incorporated in those aircraft or used for their operation;
g) As transmissões, transformações, reparações e operações de manutenção, frete e aluguer de aeronaves utilizadas pelas companhias de navegação aérea que se dediquem principalmente ao tráfego internacional, assim como as transmissões, reparações, operações de manutenção e aluguer dos objectos incorporados nas mesmas aeronaves ou que sejam utilizados para a sua exploração;
h) Supplies of stores loaded on board the aircraft referred to in the preceding point;
h) As transmissões de bens de abastecimento postos a bordo das aeronaves referidas na alínea anterior;
i) Supplies of stores loaded on board warships classified under code 8906 00 10 of the Combined Nomenclature, when they leave the country bound for a port or anchorage abroad;
i) As transmissões de bens de abastecimento postos a bordo das embarcações de guerra classificadas pelo código 8906 00 10 da Nomenclatura Combinada, quando deixem o país com destino a um porto ou ancoradouro situado no estrangeiro;
j) Supplies of services not mentioned in points (f) and (g) of this paragraph, carried out to meet the direct needs of the vessels and aircraft referred to therein and of their cargo;
j) As prestações de serviços não mencionadas nas alíneas f) e g) do presente número, efectuadas com vista às necessidades directas das embarcações e aeronaves ali referidas e da respectiva carga;
l) Supplies of goods and services carried out within the framework of diplomatic and consular relations, where the exemption derives from international agreements and conventions concluded by Portugal;
l) As transmissões de bens e as prestações de serviços efectuadas no âmbito de relações diplomáticas e consulares, cuja isenção resulte de acordos e convénios internacionais celebrados por Portugal;
m) Supplies of goods and services intended for international organisations recognised by Portugal or by any other Member State of the European Community, or for members of such organisations, within the limits and under the conditions laid down by the international conventions establishing those organisations or by headquarters agreements, including the bodies to which the Protocol of 8 April 1965 on the Privileges and Immunities of the European Communities applies, within the limits and under the conditions of that Protocol, of the agreements for its implementation or of headquarters agreements, provided that this does not lead to distortion of competition;
m) As transmissões de bens e as prestações de serviços destinadas a organizações internacionais reconhecidas por Portugal ou por qualquer outro Estado membro da Comunidade Europeia, ou a membros dessas organizações, nos limites e nas condições fixados nas convenções internacionais que instituíram as referidas organizações ou nos acordos de sede, incluindo os organismos aos quais seja aplicável o Protocolo de 8 de Abril de 1965, relativo aos Privilégios e Imunidades das Comunidades Europeias, nos limites e nas condições desse Protocolo, dos acordos relativos à sua aplicação ou dos acordos de sede, desde que daí não resultem distorções de concorrência;
n) Supplies of goods and services carried out under the North Atlantic Treaty to the armed forces of the other States that are parties to that Treaty, for the use of those forces or of the civilian staff accompanying them or for supplying their messes or canteens, where those forces take part in the common defence effort;
n) As transmissões de bens e as prestações de serviços efectuadas no âmbito do Tratado do Atlântico Norte às forças armadas dos outros Estados que são Partes no referido Tratado, para uso dessas forças armadas ou do elemento civil que as acompanha ou para o aprovisionamento das suas messes ou cantinas, quando as referidas forças se encontrem afectas ao esforço comum de defesa;
o) Supplies of goods to duly recognised bodies that export them outside the Community as part of their humanitarian, charitable or educational activities, subject to prior recognition of the right to the exemption;
o) As transmissões de bens para organismos devidamente reconhecidos que os exportem para fora da Comunidade no âmbito das suas actividades humanitárias, caritativas ou educativas, mediante prévio reconhecimento do direito à isenção;
p) Supplies of services, including transport and ancillary transactions, other than those referred to in Article 9 of this Code, that are directly connected with the external Community transit procedure, the internal Community transit procedure, the exportation of goods outside the Community, temporary importation with total exemption from duties and the importation of goods intended for one of the arrangements or places referred to in Article 15(1);
p) As prestações de serviços, incluindo os transportes e as operações acessórias, com excepção das referidas no artigo 9.º deste diploma, que estejam directamente relacionadas com o regime de trânsito comunitário externo, o procedimento de trânsito comunitário interno, a exportação de bens para fora da Comunidade, a importação temporária com isenção total de direitos e a importação de bens destinados a um dos regimes ou locais a que se refere o n.º 1 do artigo 15.º;
q) Supplies of services, other than those referred to in Article 9 of this Code, relating to the dispatch or transport of goods to other Member States, where the recipient of the services is a taxable person referred to in Article 2(1)(a), registered for VAT, who has used their identification number to make the acquisition;
q) As prestações de serviços, com excepção das referidas no artigo 9.º deste diploma, que se relacionem com a expedição ou transporte de bens destinados a outros Estados membros, quando o adquirente dos serviços seja um sujeito passivo do imposto, dos referidos na alínea a) do n.º 1 do artigo 2.º, registado em imposto sobre o valor acrescentado e que tenha utilizado o respectivo número de identificação para efectuar a aquisição;
r) The transport of persons coming from or going abroad, the transport of persons coming from or going to the Autonomous Regions, and the transport of persons between the islands of those Regions;
r) O transporte de pessoas provenientes ou com destino ao estrangeiro, bem como o das provenientes ou com destino às Regiões Autónomas, e ainda o transporte de pessoas efectuado entre as ilhas naquelas Regiões;
s) Supplies of services by intermediaries acting in the name and on behalf of another person, where they take part in transactions described in this Article or in transactions carried out outside the Community;
s) As prestações de serviços realizadas por intermediários que actuam em nome e por conta de outrem, quando intervenham em operações descritas no presente artigo ou em operações realizadas fora da Comunidade;
t) The transport of goods between the islands making up the Autonomous Regions of the Azores and Madeira, and the transport of goods between those Regions and the mainland, or any other Member State, and vice versa;
t) O transporte de mercadorias entre as ilhas que compõem as Regiões Autónomas dos Açores e da Madeira, bem como o transporte de mercadorias entre estas regiões e o continente, ou qualquer outro Estado membro, e vice-versa;
u) Supplies to the Banco de Portugal of gold in bars or in other unwrought forms;
u) As transmissões para o Banco de Portugal de ouro em barra ou em outras formas não trabalhadas;
v) Supplies of goods and services intended for the armed forces of any other State that is a party to the North Atlantic Treaty, other than the Member State of the European Community to which the goods are dispatched or the services supplied, for the use of those forces or of the civilian staff accompanying them, or for supplying their messes or canteens, where those forces take part in the common defence effort.
v) As transmissões de bens e as prestações de serviços destinadas às forças armadas de qualquer outro Estado que seja parte no Tratado do Atlântico Norte, que não seja o Estado membro da Comunidade Europeia para o qual os bens são expedidos ou os serviços prestados, para uso dessas forças armadas ou do elemento civil que as acompanham, ou para o aprovisionamento das respectivas messes ou cantinas, quando as referidas forças se encontrem afectas ao esforço comum de defesa.
x) Supplies of goods made to the taxable person who facilitates their supply within the European Union in the situations covered by Article 3(10);
x) As transmissões de bens efetuadas ao sujeito passivo que facilitar a sua transmissão dentro da União Europeia nas situações abrangidas pelo n.º 10 do artigo 3.º
z) Supplies of goods and services made to the European Commission or to agencies or bodies established under European Union law, for the performance of the tasks conferred on them by law in response to the COVID-19 pandemic;
z) As transmissões de bens e as prestações de serviços efetuadas à Comissão Europeia ou a agências ou organismos estabelecidos ao abrigo do direito da União Europeia, para o exercício das funções que lhes foram legalmente atribuídas para dar resposta à pandemia da doença COVID-19;
aa) Supplies of goods and services carried out under the European Union’s common security and defence policy to the armed forces of other Member States, for the use of those forces or of the civilian staff accompanying them or for supplying their messes or canteens, where those forces take part in a defence effort carried out for the implementation of a European Union activity;
aa) As transmissões de bens e as prestações de serviços efetuadas no âmbito da política comum de segurança e defesa da União Europeia às forças armadas de outros Estados-Membros, para uso dessas forças armadas ou do elemento civil que as acompanha ou para o aprovisionamento das suas messes ou cantinas, quando as referidas forças se encontrem afetas a um esforço de defesa realizado para a execução de uma atividade da União Europeia;
bb) Supplies of goods and services carried out under the European Union’s common security and defence policy intended for the armed forces of any other Member State, other than the Member State to which the goods are dispatched or the services supplied, for the use of those forces or of the civilian staff accompanying them or for supplying their messes or canteens, where those forces take part in a defence effort carried out for the implementation of a European Union activity.
bb) As transmissões de bens e as prestações de serviços efetuadas no âmbito da política comum de segurança e defesa da União Europeia destinadas às forças armadas de qualquer outro Estado-Membro, que não seja o Estado-Membro para o qual os bens são expedidos ou os serviços prestados, para uso dessas forças armadas ou do elemento civil que as acompanha ou para o aprovisionamento das suas messes ou cantinas, quando as referidas forças se encontrem afetas a um esforço de defesa realizado para a execução de uma atividade da União Europeia.
2. The exemptions referred to in points (d), (e) and (h) of the preceding paragraph, as regards supplies of beverages, are given effect through the exercise of the right of deduction or through refund of the tax, Article 21(1)(d) being disregarded for that purpose.
2 - As isenções referidas nas alíneas d), e) e h) do número anterior, no que se refere às transmissões de bebidas, efectivam-se através do exercício do direito à dedução ou da restituição do imposto, não se considerando, para o efeito, o disposto na alínea d) do n.º 1 do artigo 21.º
3. For the purposes of this Code, ‘stores’ (bens de abastecimento) means:
3 - Para efeitos do estabelecido neste Código, entende-se por bens de abastecimento:
a) On-board provisions, meaning products intended exclusively for consumption by the crew and passengers;
a) As provisões de bordo, sendo considerados como tais os produtos destinados exclusivamente ao consumo da tripulação e dos passageiros;
b) Fuels, motor fuels, lubricants and other products intended for the operation of the propulsion machinery and of other technical equipment installed on board;
b) Os combustíveis, carburantes, lubrificantes e outros produtos destinados ao funcionamento das máquinas de propulsão e de outros aparelhos de uso técnico instalados a bordo;
c) Ancillary products intended for the preparation, treatment and preservation of the goods carried on board.
c) Os produtos acessórios destinados à preparação, tratamento e conservação das mercadorias transportadas a bordo.
4. For the purposes of this Article, the transport of persons coming from or going to the Autonomous Regions, and the transport of persons between the islands of those Regions, are treated as the transport of persons coming from or going abroad.
4 - Para efeitos do presente artigo, é assimilado ao transporte de pessoas provenientes ou com destino ao estrangeiro o de pessoas com proveniência ou com destino às Regiões Autónomas e ainda o transporte de pessoas entre as ilhas das mesmas Regiões.
5. The exemptions in paragraph 1(d) and (f) do not apply to the transactions referred to therein where they are intended for or relate to sports or pleasure boats.
5 - As isenções das alíneas d) e f) do n.º 1 não se aplicam às operações aí referidas quando se destinem ou respeitem a barcos desportivos ou de recreio.
6. The exemption referred to in paragraph 1(z) does not apply where the goods or services acquired are used, immediately or at a later date, for taxable transactions carried out for consideration by the European Commission or by the agencies or bodies referred to therein.
6 - A isenção referida na alínea z) do n.º 1 não é aplicável quando os bens ou serviços adquiridos sejam utilizados, imediatamente ou numa data posterior, para a realização de operações tributáveis, efetuadas a título oneroso, por parte da Comissão Europeia ou das agências ou organismos aí referidos.
7. The European Commission or the agency or body concerned shall inform the Tax and Customs Authority (AT) of the event referred to in the preceding paragraph, and the supply of those goods or services then becomes subject to VAT under the conditions applicable on the date on which that use occurred.
7 - A Comissão Europeia ou a agência ou organismo em causa informam a Autoridade Tributária e Aduaneira do facto a que se reporta o número anterior, ficando a transmissão desses bens ou a prestação desses serviços sujeita a IVA nas condições aplicáveis à data em que se verificou aquela utilização.
The scope conditions of each point of paragraph 1 (including the exclusions for sports and pleasure boats, CN code 8906 00 10, the Article 9 carve-outs in points (p) and (q) and the Article 3(10) reference in point (x)), the beverage rule in paragraph 2 and the COVID-19 clawback in paragraphs 6 and 7 are retained.
