In the case of fiduciary management instruments registered in the Madeira Free Trade Zone, other trusts subject to the RCBE and other legal arrangements without legal personality with a structure or functions similar to those trusts, the following particulars must be declared in respect of the trust or legal arrangement without legal personality:
No caso dos instrumentos de gestão fiduciária registados na Zona Franca da Madeira, dos outros fundos fiduciários sujeitos ao RCBE e dos demais centros de interesses coletivos sem personalidade jurídica com uma estrutura ou funções similares àqueles fundos fiduciários, devem ser objeto de declaração, relativamente ao fundo fiduciário ou ao centro de interesses coletivos sem personalidade jurídica, os seguintes elementos:
a) The NIPC or the NIF assigned in Portugal by the competent authorities or, in its absence and provided that obtaining one in national territory is not mandatory for the purpose of carrying on an activity, a functionally equivalent number issued by the jurisdiction of residence, if any;
a) O NIPC ou o NIF atribuído em Portugal pelas autoridades competentes ou, na sua ausência e desde que a sua obtenção em território nacional não seja obrigatória para efeitos do exercício de atividade, um número funcional equivalente emitido pela jurisdição de residência, caso exista;
c) The date of establishment and the duration, where fixed, as well as the date and nature of any events modifying or terminating it;
c) A data da constituição e a duração, quando determinada, bem como a data e a natureza dos respetivos factos modificativos e extintivos;
f) The assets forming part of the trust or legal arrangement without legal personality;
f) Os bens que integram o fundo fiduciário ou o centro de interesses coletivos sem personalidade jurídica;
g) The name and registered office of the trustee, where the trustee is not a natural person;
g) A denominação e a sede do administrador fiduciário, quando não se trate de pessoa singular;
h) The rights and obligations of the trustees among themselves, where there is more than one trustee;
h) Os direitos e as obrigações dos administradores fiduciários entre si, em caso de exercício plural;
i) The particulars provided for in points (a) and (b) relating to the management company, where applicable.
i) Os elementos previstos nas alíneas a) e b) relativos à sociedade gestora, quando aplicável.
The nine particulars to be declared for trusts and similar arrangements, including the condition in point (a) for using a foreign functionally equivalent number, are retained.
