RCBE Article 9: Data collected in the declaration

1. The following data are collected in the beneficial owner declaration:

1 - Na declaração do beneficiário efetivo são recolhidos os seguintes dados:

a) As regards the entity:

a) Quanto à entidade:

i) The legal person identification number (NIPC) assigned in Portugal by the competent authority and, in the case of a non-resident entity, the NIF or equivalent number issued by the competent authority of the jurisdiction of residence, if any;

i) O número de identificação de pessoa coletiva (NIPC) atribuído em Portugal pela autoridade competente e, tratando-se de entidade não residente, o NIF ou número equivalente emitido pela autoridade competente da jurisdição de residência, caso exista;

ii) The business name or corporate name;

ii) A firma ou denominação;

iii) The legal form;

iii) A natureza jurídica;

iv) The registered office, including the jurisdiction of registration, in the case of foreign entities;

iv) A sede, incluindo a jurisdição de registo, no caso das entidades estrangeiras;

v) The economic activity code (CAE);

v) O código de atividade económica (CAE);

vi) The Legal Entity Identifier, where applicable; and

vi) O identificador único de entidades jurídicas (Legal Entity Identifier), quando aplicável; e

vii) The institutional email address.

vii) O endereço eletrónico institucional.

b) As regards the beneficial owner and the natural persons referred to in Article 8(2):

b) Relativamente ao beneficiário efetivo e às pessoas singulares referidas no n.º 2 do artigo anterior:

i) Full name;

i) O nome completo;

ii) Date of birth;

ii) A data de nascimento;

iii) Place of birth;

iii) A naturalidade;

iv) Nationality or nationalities;

iv) A nacionalidade ou as nacionalidades;

v) Full address of permanent residence, including the country;

v) A morada completa de residência permanente, incluindo o país;

vi) Identity document details;

vi) Os dados do documento de identificação;

vii) The NIF, where applicable, and, in the case of a foreign national, the NIF issued by the competent authorities of the State or States of their nationality, or an equivalent number;

vii) O NIF, quando aplicável, e, tratando-se de cidadão estrangeiro, o NIF emitido pelas autoridades competentes do Estado, ou dos Estados, da sua nacionalidade, ou número equivalente;

viii) Contact email address;

viii) O endereço eletrónico de contacto;

c) As regards the declarant and the legal representative of a beneficial owner who is a minor or an adult under accompaniment (maior acompanhado):

c) Relativamente ao declarante e ao representante legal do beneficiário efetivo menor ou maior acompanhado:

i) Name;

i) O nome;

ii) Full address of permanent residence or of professional domicile, including the country;

ii) A morada completa de residência permanente ou do domicílio profissional, incluindo o país;

iii) Identity document or professional licence details;

iii) Os dados do documento de identificação ou da cédula profissional;

iv) The NIF, where applicable;

iv) O NIF, quando aplicável;

v) The capacity in which they act;

v) A qualidade em que atua;

vi) Contact email address.

vi) O endereço eletrónico de contacto.

2. Whenever the person or persons indicated as beneficial owners are not resident in Portugal, their tax representative, if any, must additionally be identified by name, full address and NIF.

2 - Sempre que a pessoa ou as pessoas indicadas como beneficiários efetivos sejam não residentes em Portugal, deve adicionalmente ser identificado o seu representante fiscal, caso exista, com o nome, a morada completa e o NIF.

3. The information on the beneficial owner, as well as on the persons referred to in Article 8(2)(e) and (f), always includes the circumstances indicating that status and the economic interest held, and, where applicable, the chain of control must be indicated, identifying the entities that make it up.

3 - A informação sobre o beneficiário efetivo, bem como sobre as pessoas a que se referem as alíneas e) e f) do n.º 2 do artigo anterior, inclui sempre as circunstâncias indiciadoras dessa qualidade e do interesse económico detido, devendo ser indicada, nos casos aplicáveis, a cadeia de controlo com identificação das entidades que a compõem.

4. The information on the circumstances indicating beneficial owner status and the economic interest held must include its source, by indicating the public administration database, in particular that of the commercial registry, or, where that is not possible, by attaching a sufficient document.

4 - A informação sobre as circunstâncias indiciadoras da qualidade de beneficiário efetivo e o interesse económico detido deve incluir a respetiva fonte, mediante a indicação da base de dados da Administração Pública, designadamente, a do registo comercial ou, quando tal não seja possível, por junção de documento bastante.
