1. The following are entitled to make the declaration provided for in the preceding Article:
1 - Têm legitimidade para efetuar a declaração prevista no artigo anterior:
a) The members of the management bodies of companies or the persons performing equivalent functions in other legal persons;
a) Os membros dos órgãos de administração das sociedades ou as pessoas que desempenhem funções equivalentes noutras pessoas coletivas;
b) Natural persons acting in the capacities referred to in paragraphs 2 and 3 of the preceding Article.
b) As pessoas singulares que atuem nas qualidades referidas nos n.os 2 e 3 do artigo anterior.
2. Without prejudice to the entitlement established in point (a) of the preceding paragraph, the beneficial owner declaration may always be made by the founding members of legal persons through special immediate or online incorporation procedures.
2 - Sem prejuízo da legitimidade estabelecida na alínea a) do número anterior, a declaração do beneficiário efetivo pode sempre ser efetuada pelos membros fundadores das pessoas coletivas através de procedimentos especiais de constituição imediata ou online.
3. Entitlement may, whenever possible, be verified automatically using the information contained in databases holding information relevant for that purpose, under terms to be defined by a protocol entered into between IRN, I. P., and the controller, where the database is external to that Institute, which protocol is subject to prior review by the National Data Protection Commission.
3 - A legitimidade pode, sempre que possível, ser verificada automaticamente por recurso à informação contida nas bases de dados que disponham de informação relevante para o efeito, nos termos a definir por protocolo celebrado entre o IRN, I. P., e a entidade responsável pelo tratamento de dados, quando se trate de base de dados externa àquele Instituto, o qual é sujeito a apreciação prévia da Comissão Nacional de Proteção de Dados.
The two categories of persons entitled to declare, the founding members' entitlement under immediate or online incorporation procedures, and automatic verification under a protocol subject to prior review by the National Data Protection Commission are retained.
