1. The beneficial owner declaration must contain the relevant information on:

2. In the case of fiduciary management instruments registered in the Madeira Free Trade Zone, other trusts subject to the RCBE and other legal arrangements without legal personality with a structure or functions similar to those trusts, in addition to information on the entity and the declarant, information on the following must be declared:
2 - Nos casos dos instrumentos de gestão fiduciária registados na Zona Franca da Madeira, dos outros fundos fiduciários sujeitos ao RCBE e dos demais centros de interesses coletivos sem personalidade jurídica com uma estrutura ou funções similares àqueles fundos fiduciários, além da informação sobre a entidade e o declarante, deve ser objeto de declaração a informação sobre:
a) The founder or founders, the settlor or settlors;
a) O fundador ou os fundadores, o instituidor ou os instituidores;
b) The trustee or trustees and, if applicable, their substitutes, where they are natural persons;
b) O administrador ou os administradores fiduciários e, se aplicável, os respetivos substitutos, quando sejam pessoas singulares;
c) The legal representatives of the trustee or trustees, where the latter are legal persons;
c) Os representantes legais do administrador ou dos administradores fiduciários, quando estes sejam pessoas coletivas;
e) The beneficiaries and, where they exist, their substitutes, without prejudice to the following paragraph;
e) Os beneficiários e, quando existam, os respetivos substitutos, sem prejuízo do disposto no número seguinte;
f) Any other natural person exercising effective control.
f) Qualquer outra pessoa singular que exerça o controlo efetivo.
3. Where the persons benefiting from the trust or legal arrangement without legal personality have not yet been determined, all circumstances enabling identification of the class or classes of persons in whose main interest the trust or legal arrangement without legal personality was set up or operates must be declared.
3 - Quando as pessoas que beneficiam do fundo fiduciário ou do centro de interesses coletivos sem personalidade jurídica ainda não tiverem sido determinadas, devem ser objeto de declaração todas as circunstâncias que permitam a identificação da categoria ou das categorias de pessoas em cujo interesse principal o fundo fiduciário ou o centro de interesses coletivos sem personalidade jurídica foi constituído ou exerce a sua atividade.
4. The information contained in the RCBE may, whenever possible, be collected automatically using information already contained in public administration databases, under terms to be defined by a protocol entered into between IRN, I. P., and the controller, where the database is external to that Institute, which protocol is subject to prior review by the National Data Protection Commission; information collected automatically is subject to confirmation by the declarant where necessary.
4 - A informação constante do RCBE pode, sempre que possível, ser recolhida automaticamente por recurso à informação já contida nas bases de dados da Administração Pública, nos termos a definir por protocolo celebrado entre o IRN, I. P., e a entidade responsável pelo tratamento de dados, quando se trate de base de dados externa àquele Instituto, o qual é sujeito a apreciação prévia da Comissão Nacional de Proteção de Dados, estando a informação recolhida automaticamente sujeita a confirmação pelo declarante quando necessário.
The general content of the declaration (points (b) and (c) repealed), the six additional categories of persons for trusts and similar arrangements, the rule for beneficiaries not yet determined, and automatic collection under a protocol subject to prior review by the National Data Protection Commission and to confirmation by the declarant are retained.
