1. Taxpayers may opt to deduct from the tax charge calculated under Article 90(1)(a) of the Corporate Income Tax Code, up to the amount of that charge, the amount of AIMI paid during the financial year to which the tax relates, limited to the fraction corresponding to the income generated by properties subject to the AIMI in the course of a letting or accommodation activity.

2. Opting for the deduction provided for in the preceding paragraph precludes the deduction of this additional tax in determining taxable profit for corporate income tax (IRC) purposes.

#

3. The deduction provided for in this article does not apply where the properties are held, directly or indirectly, by an entity resident or domiciled in a country, territory or region subject to a clearly more favourable tax regime included in the list approved by order (portaria) of the member of the Government responsible for finance.

4. The deduction provided for in paragraph 1 is made on the same terms as the deduction provided for in Article 90(2)(c) of the Corporate Income Tax Code, except as regards the application of the limit provided for in Article 92(1) of that Code.

What we checked in this article
