1. A company which is a resident of a Contracting State and has a permanent establishment in the other Contracting State may be subjected to the tax levied on distributions of profits provided for by the domestic law of that other State, the applicable rate being that resulting from the application of paragraph 2 of Article 11.

However, the portion of the distributions of profits actually liable to the aforementioned tax may not exceed the amount of the industrial and commercial profits made by the permanent establishment, computed under the conditions laid down by the provisions of this Convention and after deduction of the tax borne by those profits.

2. A company which is a resident of a Contracting State may not be subjected in the other State to the levy referred to in paragraph 1 by reason of its participation in the management or capital of a company which is a resident of the other Contracting State or by reason of any other relationship with that company; but the profits distributed by the latter company and liable to the levy shall, where appropriate, be increased, for the purposes of assessing that levy, by all profits or advantages which the first company may have derived indirectly under the conditions provided for in Article 9, double taxation of those profits and advantages being avoided in accordance with the provisions of Article 24.

Applying the law

Treaty relief between Portugal and France, claimed correctly

Treaty rates are not automatic in Portugal: the recipient must give the payer a form certified by its own tax authority before the tax is due, or claim a refund afterwards. We check which article applies, the rate and the paperwork.
