Artigo 11.º · Dividendos

Convenção Portugal–França · signed 14 January 1971 · in force 18 November 1972 · English: our translation

#

1. Dividends paid by a company which is a resident of a Contracting State to a resident of the other Contracting State may be taxed in that other State.

#

2. However, such dividends may also be taxed in the Contracting State of which the company paying the dividends is a resident, and according to the law of that State, but the tax so charged shall not exceed 15 per cent of the gross amount of the dividends.

#

This paragraph shall not affect the taxation of the company in respect of the profits out of which the dividends are paid.

3. The term “dividends” as used in this Article means income from shares, “jouissance” shares or “jouissance” rights, mining shares, founders’ shares or other rights, not being debt-claims, participating in profits, as well as income from other corporate rights which is assimilated to income from shares by the taxation law of the State of which the company making the distribution is a resident.

#

Income attributed to a participant in a joint-venture account arrangement (conta em participação) provided for in Article 224 of the Portuguese Commercial Code shall also be treated as dividends.

4. The provisions of paragraphs 1 and 2 shall not apply if the recipient of the dividends, being a resident of a Contracting State, has in the other Contracting State, of which the company paying the dividends is a resident, a permanent establishment with which the holding by virtue of which the dividends are paid is effectively connected. In such a case, the provisions of Article 7 shall apply.

5. Where dividends distributed by a company which is a resident of France give rise to the levy of the advance tax on distributions (précompte mobilier), the recipients of such dividends who are residents of Portugal may obtain a refund of that advance tax, less the tax withheld at source on the amount refunded, charged in accordance with the provisions of this Article.

Applying the law

Treaty relief between Portugal and France, claimed correctly

Treaty rates are not automatic in Portugal: the recipient must give the payer a form certified by its own tax authority before the tax is due, or claim a refund afterwards. We check which article applies, the rate and the paperwork.
