1. A rectification that is not liable to prejudice the rights of the registered holders is made, even without their consent, in the following cases:
1 - A rectificação que não seja susceptível de prejudicar direitos dos titulares inscritos é efectuada, mesmo sem necessidade do seu consentimento, nos casos seguintes:
a) Whenever the inaccuracy results from a discrepancy with the title document, upon examination of the documents on which the registration was based;
a) Sempre que a inexactidão provenha da desconformidade com o título, analisados os documentos que serviram de base ao registo;
b) Whenever the inaccuracy results from a defect in the title documents and rectification is applied for by any interested party on the basis of a sufficient document.
b) Sempre que, provindo a inexactidão de deficiência dos títulos, a rectificação seja requerida por qualquer interessado com base em documento bastante.
2. Rectification of a registration that is inaccurate owing to a discrepancy with the title document shall be deemed not to prejudice the holder of the right registered in it.
2 - Deve entender-se que a rectificação de registo inexacto por desconformidade com o título não prejudica o titular do direito nele inscrito.
3. The rectification is presumed not to prejudice an estate if the administrator of the estate (cabeça-de-casal) so declares.
3 - Presume-se que da rectificação não resulta prejuízo para a herança se tal for declarado pelo respectivo cabeça-de-casal.
The condition that the rectification cannot prejudice registered holders, the two cases (discrepancy with the title; defective title with a sufficient document), the deemed absence of prejudice for discrepancy with the title and the presumption based on the estate administrator's declaration are retained.
