1. A decision rejecting an application for rectification may be challenged by lodging an administrative appeal with the Director-General of Registries and Notary, under Articles 101 et seq., or by bringing a judicial challenge before the district court (tribunal da comarca) for the territorial area to which the registry office belongs, under the following paragraphs.
1 - A decisão de indeferimento do pedido de rectificação pode ser impugnada mediante a interposição de recurso hierárquico para o director-geral dos Registos e do Notariado, nos termos previstos nos artigos 101.º e seguintes ou mediante impugnação judicial para o tribunal da comarca da área da circunscrição a que pertence a conservatória, nos termos dos números seguintes.
2. Any interested party and the Public Prosecution Service shall have standing to challenge the registrar’s decision in court.
2 - Têm legitimidade para impugnar judicialmente a decisão do conservador qualquer interessado e o Ministério Público.
3. The judicial challenge provided for in paragraph 1 shall have suspensive effect and must be brought within the time limit laid down in Article 685 of the Code of Civil Procedure.
3 - A impugnação judicial prevista no n.º 1 tem efeito suspensivo e deve ser proposta no prazo previsto no artigo 685.º do Código de Processo Civil.
4. The judicial challenge shall be brought by means of an application setting out the grounds on which it is based.
4 - A impugnação judicial é proposta por meio de requerimento onde são expostos os respectivos fundamentos.
5. An action by way of judicial challenge shall be deemed brought when the relevant application is filed at the registry office at which the decision challenged was given in the proceedings, the bringing of the action being noted in the Daybook (Diário).
5 - A propositura de acção de impugnação judicial considera-se efectuada com a apresentação do respectivo requerimento na conservatória em que o processo foi objecto da decisão impugnada, sendo aquela anotada no Diário.
