a) Where it is false or has been made on the basis of false instruments;

d) Where it has been signed by a person lacking functional competence, save as provided in Article 369(2) of the Civil Code, and cannot be confirmed;

e) Where it has been drawn up without prior filing.

2. Void registrations may only be rectified in the cases provided for by law, if the action for a declaration of nullity has not been registered.

3. The nullity of a registration may, however, only be invoked after it has been declared by a judicial decision that has become res judicata.

4. A declaration of nullity of a registration does not prejudice rights acquired for consideration by a third party in good faith, if the registration of the corresponding facts predates the registration of the action for nullity.
