1. Wherever possible, deficiencies in the process of registration by transcription must be remedied ex officio on the basis of the documents filed or already held by the registry office, or by direct access to information contained in the databases of Public Administration bodies or services.
1 - Sempre que possível, as deficiências do processo de registo por transcrição devem ser supridas oficiosamente com base nos documentos apresentados ou já existentes no serviço de registo ou por acesso directo à informação constante de bases de dados das entidades ou serviços da Administração Pública.
2. Where the deficiencies cannot be remedied as provided for in the preceding paragraph, and the deficiency neither involves a new application for registration nor constitutes a ground for refusal under points (c) to (e) and (h) of Article 48(1), the competent registry office notifies the interested party of this by email, where the interested party has provided an email address, or by any other appropriate means, so that the interested party remedies the deficiency within five days, failing which the registration will be made as provisional or refused.
2 - Não sendo possível o suprimento das deficiências, nos termos previstos no número anterior, e tratando-se de deficiência que não envolva novo pedido de registo nem constitua motivo de recusa nos termos das alíneas c) a e) e h) do n.º 1 do artigo 48.º, o serviço de registo competente comunica este facto ao interessado, por correio eletrónico, sempre que o interessado tenha fornecido o respetivo endereço, ou por qualquer meio idóneo, para que este, no prazo de cinco dias, proceda a tal suprimento, sob pena de o registo ser lavrado como provisório ou recusado.
3. The registration is not made as provisional or refused if the deficiencies concerned relate to the absence of documents to be issued by the bodies referred to in paragraph 1 and the information contained in them cannot be obtained as provided for in that paragraph, provided that the interested party has expressly asked the registry office, in person or in writing by email or by registered post, within the period referred to in the preceding paragraph, to obtain them directly from the Public Administration bodies or services.
3 - O registo não é lavrado provisoriamente ou recusado se as deficiências em causa respeitarem à omissão de documentos a emitir pelas entidades referidas no n.º 1 e a informação deles constante não puder ser obtida nos termos aí previstos, desde que o interessado tenha expressamente solicitado ao serviço de registo, pessoalmente ou por escrito, através de correio eletrónico ou sob registo postal, e no prazo referido no número anterior, que diligencie pela sua obtenção diretamente às entidades ou serviços da Administração Pública.
5. A failure to file the title document that constitutes a ground for refusal under point (b) of Article 48(1) may be remedied, in compliance with the preceding paragraphs, provided that the fact subject to registration predates the date of filing or, where it bears the same date, the time of filing, if the title document states the time at which it was signed or completed.
5 - A falta de apresentação do título que constitua motivo de recusa, nos termos da alínea b) do n.º 1 do artigo 48.º pode ser suprida, com observância dos números anteriores, desde que o facto sujeito a registo seja anterior à data da apresentação ou à hora desta se, sendo da mesma data, o título contiver a menção da hora em que foi assinado ou concluído.
7. The remedying of deficiencies under paragraphs 2, 3 and 5 is subject to payment of the amounts due.
7 - O suprimento de deficiências nos termos dos n.os 2, 3 e 5 depende da entrega das quantias devidas.
8. Decisions taken in the course of remedying deficiencies are not subject to administrative appeal or judicial challenge.
8 - Das decisões tomadas no âmbito do suprimento de deficiências não cabe recurso hierárquico ou impugnação judicial.
