1. Where the company does not request registration under paragraph 5 of the preceding article, any person may ask the registry office itself to arrange the registration by filing of facts relating to holdings and their holders.
1 - No caso de a sociedade não promover o registo, nos termos do n.º 5 do artigo anterior, qualquer pessoa pode solicitar junto da conservatória que esta promova o registo por depósito de factos relativos a participações sociais e respectivos titulares.
2. In the case provided for in the preceding paragraph, the registry office shall notify the company to request the registration within 10 days, failing which the registry office shall carry out the registration in accordance with the following paragraph.
2 - No caso previsto no número anterior, a conservatória notifica a sociedade para que esta, no prazo de 10 dias, promova o registo sob pena de, não o fazendo, a conservatória proceder ao registo, nos termos do número seguinte.
3. If, within the same period, the company neither requests the registration nor objects to it, the registry office shall register the fact, archive the documents that have been delivered and send a copy of them to the company.
3 - Se a sociedade não promover o registo nem se opuser, no mesmo prazo, a conservatória regista o facto, arquiva os documentos que tiverem sido entregues e envia cópia dos mesmos à sociedade.
4. The company’s objection shall be assessed by the registrar, after hearing the interested parties.
4 - A oposição da sociedade deve ser apreciada pelo conservador, ouvidos os interessados.
5. If the registrar decides to carry out the registration, the company shall pay the applicant the amounts paid by the applicant as registry fees and other charges and, if the registrar rejects the request, the applicant shall pay the company the amounts paid by the company as registry fees and other charges.
5 - Se o conservador decidir promover o registo, a sociedade deve entregar ao requerente as quantias por este pagas a título de emolumentos e outros encargos e, no caso de o conservador indeferir o pedido, deve este entregar à sociedade as quantias por esta pagas a título de emolumentos e outros encargos.
