The grant of a temporary stay visa to nationals of States Parties to the World Trade Organization who are transferred in the context of the provision of services or of vocational training in Portuguese territory is subject to the following conditions:
A concessão de visto de estada temporária a cidadãos nacionais de Estados Partes da Organização Mundial do Comércio, transferidos no contexto da prestação de serviços ou da realização de formação profissional em território português, depende da verificação das seguintes condições:
a) The transfer must take place between establishments of the same undertaking or the same group of undertakings, and the establishment located in Portuguese territory must provide services equivalent to those provided by the establishment from which the foreign national is transferred;
a) A transferência tem de efectuar-se entre estabelecimentos de uma mesma empresa ou mesmo grupo de empresas, devendo o estabelecimento situado em território português prestar serviços equivalentes aos prestados pelo estabelecimento de onde é transferido o cidadão estrangeiro;
b) The transfer must concern partners or employees who have been with the establishment located in another State Party to the World Trade Organization for at least one year and who fall within one of the following categories:
b) A transferência tem de referir-se a sócios ou trabalhadores subordinados, há pelo menos um ano, no estabelecimento situado noutro Estado Parte da Organização Mundial do Comércio, que se incluam numa das seguintes categorias:
i) Those who, holding managerial powers, work as senior executives of the undertaking and primarily manage an establishment or department, receiving general guidance from the board of directors;
i) Os que, possuindo poderes de direcção, trabalhem como quadros superiores da empresa e façam, essencialmente, a gestão de um estabelecimento ou departamento, recebendo orientações gerais do conselho de administração;
ii) Those who possess specific technical knowledge essential to the activity, its research equipment, its techniques or its management;
ii) Os que possuam conhecimentos técnicos específicos essenciais à actividade, ao equipamento de investigação, às técnicas ou à gestão da mesma;
iii) Those who are to receive vocational training at the establishment located in national territory.
iii) Os que devam receber formação profissional no estabelecimento situado em território nacional.
