1. Visas may be cancelled in the following situations:
1 - Os vistos podem ser cancelados nas seguintes situações:
a) Where the holder does not meet the conditions for its grant;
a) Quando o seu titular não satisfaça as condições da sua concessão;
b) Where they were issued on the basis of false statements, the use of fraudulent means or the invocation of reasons other than those which prompted the holder’s entry into the country;
b) Quando tenham sido emitidos com base em prestação de falsas declarações, utilização de meios fraudulentos ou através da invocação de motivos diferentes daqueles que motivaram a entrada do seu titular no País;
c) Where the holder has been subject to a measure of removal from national territory, is the subject of an alert for the purposes of refusal of entry and stay in the UCFE Integrated Information System (SII UCFE), or is the subject of an alert for the purposes of return or of refusal of entry and stay in the Schengen Information System (SIS);
c) Quando o respetivo titular tenha sido objeto de uma medida de afastamento do território nacional, se encontre indicado para efeitos de recusa de entrada e de permanência no SII UCFE ou se encontre indicado para efeitos de regresso ou para efeitos de recusa de entrada e de permanência no SIS;
d) Where the holder constitutes a danger or serious threat to public policy, security or national defence, owing to their involvement in activities related to the commission of terrorism, under the relevant law.
d) Quando o seu titular constitua perigo ou ameaça grave para a ordem pública, a segurança ou a defesa nacional, pelo seu envolvimento em atividades relacionadas com a prática do terrorismo, nos termos da respetiva lei.
2. Residence visas and temporary stay visas may also be cancelled where the holder, without good reason, is absent from the country for a period of 60 days during the validity of the visa.
2 - Os vistos de residência e de estada temporária podem ainda ser cancelados quando o respectivo titular, sem razões atendíveis, se ausente do País pelo período de 60 dias, durante a validade do visto.
3. The previous paragraphs also apply during the validity of extensions of stay granted under this Law.
3 - O disposto nos números anteriores é igualmente aplicável durante a validade das prorrogações de permanência concedidas nos termos previstos na presente lei.
4. The residence visa shall also be cancelled if the application for a residence permit is refused.
4 - O visto de residência é ainda cancelado em caso de indeferimento do pedido de autorização de residência.
5. After the visa holder has entered national territory, the cancellation of the visas referred to in the previous paragraphs falls within the competence of the member of the Government responsible for internal administration, who may delegate it to the General Commander of the National Republican Guard (GNR) or the National Director of the Public Security Police (PSP), with the power to subdelegate, and of the member of the Government responsible for migration, who may delegate it to the board of directors of the Agency for Integration, Migration and Asylum (AIMA), with the power to subdelegate.
5 - Após a entrada do titular do visto em território nacional, o cancelamento de vistos a que se referem os números anteriores é da competência do membro do Governo responsável pela área da administração interna, com faculdade de delegação no comandante-geral da GNR ou no diretor nacional da PSP, com a faculdade de subdelegar, e do membro do Governo responsável pela área das migrações, que pode delegar no conselho diretivo da AIMA, I. P., com a faculdade de subdelegar.
6. The cancellation of visas under the previous paragraph shall be communicated electronically to the Directorate-General for Consular Affairs and Portuguese Communities.
6 - O cancelamento de vistos nos termos do número anterior é comunicado por via electrónica à Direcção-Geral dos Assuntos Consulares e das Comunidades Portuguesas.
7. The cancellation of visas before the holder arrives in national territory falls within the competence of the diplomatic missions, consular posts or consular sections, and shall be communicated electronically to the security forces and services, the Borders and Foreigners Coordination Unit (UCFE) and AIMA.
7 - O cancelamento de vistos antes da chegada do titular a território nacional é da competência das missões diplomáticas, dos postos ou das secções consultares, sendo comunicado por via eletrónica às forças e serviços de segurança, à UCFE e à AIMA, I. P.
