1. A residence visa for obtaining a residence permit shall be granted to a researcher, higher education student, secondary school student, trainee or volunteer in order to carry out scientific research activities in national territory, or to attend a higher education study programme, a secondary school pupil exchange programme or a traineeship, provided that they:
1 - Ao investigador, ao estudante do ensino superior, ao estudante do ensino secundário, ao estagiário ou ao voluntário é concedido visto de residência para obtenção de autorização de residência para, em território nacional, exercer atividades de investigação cientifica, para frequentar um programa de estudos de ensino superior, um programa de intercâmbio de estudantes de ensino secundário ou um estágio, desde que:
b) Have health insurance, or equivalent, covering the planned duration of the stay.
b) Disponha de seguro de saúde, ou equivalente, que cubra a duração prevista da estada.
c) Meet the special conditions laid down in this Article.
c) Preencha as condições especiais estabelecidas no presente artigo.
2. A researcher applying for a visa for research in national territory must have an employment contract or a hosting agreement with a research centre or higher education institution, or have been admitted to a research centre or higher education institution, and must hold a research grant or fellowship or present a statement of responsibility signed by the research centre or higher education institution guaranteeing their admission as well as the costs of their stay.
2 - O investigador que requeira visto para investigação em território nacional deve ter contrato de trabalho ou convenção de acolhimento com centro de investigação ou instituição de ensino superior, ou ter sido admitido em centro de investigação ou instituição de ensino superior, e possuir bolsa ou subvenção de investigação ou apresentar termo de responsabilidade subscrito pelo centro de investigação ou instituição de ensino superior que garanta a sua admissão, bem como as despesas de estada.
3. Researchers admitted to a research centre or higher education institution officially recognised under Article 91-B are exempt from submitting documents proving compliance with paragraph 1(b) and paragraph 2, as well as with Article 52(1)(d) and (f) and Article 52(3).
3 - Os investigadores admitidos em centro de investigação ou instituição de ensino superior oficialmente reconhecido nos termos do artigo 91.º-B estão dispensados da apresentação de documentos comprovativos do disposto na alínea b) do n.º 1, no n.º 2, bem como do disposto nas alíneas d) e f) do n.º 1 e no n.º 3 do artigo 52.º
4. A higher education student who meets the conditions of Article 3(m) must prove that they meet the admission requirements of, or have been accepted by, a higher education institution to attend a study programme, and that they have sufficient resources to attend it.
4 - O estudante do ensino superior que preencha as condições da alínea m) do artigo 3.º deve comprovar que preenche as condições de admissão ou foi aceite em instituição do ensino superior para frequência de um programa de estudos e que possui os recursos suficientes para a respetiva frequência.
5. A higher education student admitted to a higher education institution approved under Article 91(5) et seq. is exempt from submitting documents proving compliance with paragraph 1(b) and the previous paragraph, as well as with Article 52(1)(d) and (f).
5 - O estudante do ensino superior admitido em instituição de ensino superior aprovada nos termos do n.º 5 e seguintes do artigo 91.º está dispensado da apresentação de documentos comprovativos do disposto na alínea b) do n.º 1 e no número anterior, bem como do disposto nas alíneas d) e f) do n.º 1 do artigo 52.º
6. A secondary school student who meets the conditions of Article 3(n) must prove that they:
6 - O estudante do ensino secundário que preencha as condições da alínea n) do artigo 3.º deve comprovar que:
a) Have reached the minimum age and do not exceed the maximum age set for this purpose by order (portaria) of the members of the Government responsible for migration and education;
a) Tem idade mínima e não excede a idade máxima fixada, para o efeito, por portaria dos membros do Governo responsáveis pelas áreas das migrações e da educação;
b) Have been accepted by an educational establishment, and their admission may take place under a pupil exchange programme run by an organisation recognised for that purpose by the member of the Government responsible for education, or under an educational project;
b) Foi aceite num estabelecimento de ensino, podendo a sua admissão realizar-se no âmbito de um programa de intercâmbio de estudantes, por uma organização reconhecida pelo membro do governo responsável pela área da educação, para esse efeito ou no âmbito de um projeto educativo;
c) During the period of stay, are hosted by a family or have accommodation secured in suitable facilities, within the educational establishment or elsewhere, provided that these meet the conditions set out in the pupil exchange programme or the educational project.
c) Durante o período da estada, é acolhido por família ou tem alojamento assegurado em instalações adequadas, dentro do estabelecimento de ensino ou noutras, desde que cumpram as condições fixadas no programa de intercâmbio de estudantes ou no projeto educativo.
7. A trainee who meets the conditions of Article 3(l) must prove that they have been accepted as a trainee by a certified host entity and must present a theoretical and practical training agreement, in the field of the higher education degree they hold or of the course of study they are attending, which must contain:
7 - O estagiário que preencha as condições da alínea l) do artigo 3.º deve comprovar que foi aceite como estagiário por uma entidade de acolhimento certificada e apresentar um contrato de formação teórica e prática, no domínio do diploma do ensino superior de que é possuidor ou do ciclo de estudos que frequenta, o qual deve conter:
a) A description of the training programme, in particular its educational objectives or learning components;
a) Descrição do programa de formação, nomeadamente os respetivos objetivos educativos ou componentes de aprendizagem;
c) The location and supervision arrangements of the traineeship;
c) Localização e condições de supervisão do estágio;
d) A description of the legal relationship between the trainee and the host entity;
d) Caracterização da relação jurídica entre o estagiário e a entidade de acolhimento;
e) A statement that the traineeship does not replace a job and that the host entity undertakes to reimburse the State for the costs of stay and removal if the trainee remains illegally in national territory.
e) Menção de que o estágio não substitui um posto de trabalho e de que a entidade de acolhimento se responsabiliza pelo reembolso ao Estado das despesas de estada e afastamento, caso o estagiário permaneça ilegalmente em território nacional.
a) They have a contract with the host entity responsible for the voluntary service programme, setting out a description of the content and duration of the voluntary service programme, the hours, the supervision arrangements and a guarantee that board and lodging costs will be covered, including a minimum sum of allowances or pocket money;
a) Tem contrato com a entidade de acolhimento responsável pelo programa de voluntariado, do qual conste uma descrição do conteúdo e duração do programa de voluntariado, horário, condições de supervisão e garantia da cobertura das despesas de alimentação e alojamento, incluindo uma soma mínima de ajudas de custo ou dinheiro de bolso;
b) The host entity has taken out third-party liability insurance, except in the case of volunteers taking part in the European Voluntary Service.
b) A entidade de acolhimento subscreveu um seguro de responsabilidade civil, salvo no caso dos voluntários que participam no Serviço Voluntário Europeu.
9. For the purposes of granting a residence visa under this Article, the minimum amount of means of subsistence laid down in the order (portaria) referred to in Article 52(1)(d) may be waived, having regard to the circumstances of the specific case.
9 - Para efeitos de concessão de visto de residência ao abrigo do presente artigo, o montante mínimo dos meios de subsistência previsto na portaria a que se refere a alínea d) do n.º 1 do artigo 52.º pode ser dispensado, atentas as circunstâncias do caso concreto.
10. The procedure for granting a residence visa to the third-country nationals referred to in paragraph 1 who take part in Community programmes promoting mobility towards the European Union or the Community of Portuguese-Speaking Countries (CPLP), or in their interest, shall be simplified, under terms to be defined by order (portaria) of the members of the Government responsible for foreign affairs, migration and administrative modernisation.
10 - O procedimento de concessão de visto de residência aos nacionais de Estados terceiros indicados no n.º 1 que participem em programas comunitários de promoção da mobilidade para a União Europeia ou para a Comunidade dos Países de Língua Portuguesa ou no seu interesse é simplificado, nos termos a definir por portaria dos membros do Governo responsáveis pelas áreas dos negócios estrangeiros, das migrações e da modernização administrativa.
11. A residence visa shall also be granted to third-country nationals who have been admitted to courses at qualification levels 4 or 5 of the National Qualifications Framework (QNQ) or to training courses provided by educational or vocational training establishments, provided that they meet the conditions laid down in paragraph 1(a) and (b).
11 - É ainda concedido visto de residência aos nacionais de Estado terceiro que tenham sido admitidos a frequentar cursos dos níveis de qualificação 4 ou 5 do Quadro Nacional de Qualificações (QNQ) ou cursos de formação ministrados por estabelecimentos de ensino ou de formação profissional, desde que preencham as condições estabelecidas nas alíneas a) e b) do n.º 1.
