1. Without prejudice to forms of youth tourism or youth exchange, the competent authority must refuse entry into the country to foreign nationals under 18 years of age who are not accompanied by the person exercising parental responsibilities or where there is no one in Portuguese territory, duly authorised by their legal representative, who takes responsibility for their stay.
1 - Sem prejuízo de formas de turismo ou intercâmbio juvenil, a autoridade competente deve recusar a entrada no País aos cidadãos estrangeiros menores de 18 anos quando desacompanhados de quem exerce as responsabilidades parentais ou quando em território português não exista quem, devidamente autorizado pelo representante legal, se responsabilize pela sua estada.
2. Save in duly justified exceptional cases, a foreign minor is not authorised to enter Portuguese territory where the person exercising parental responsibilities or the person to whom the minor has been formally entrusted is not admitted to the country.
2 - Salvo em casos excecionais, devidamente justificados, não é autorizada a entrada em território português de menor estrangeiro quando quem exerce as responsabilidades parentais ou a pessoa a quem esteja formalmente confiado não seja admitida no País.
3. If the foreign minor is not admitted to Portuguese territory, entry must also be refused to the person to whom the minor has been entrusted.
3 - Se o menor estrangeiro não for admitido em território português, deve igualmente ser recusada a entrada à pessoa a quem tenha sido confiado.
4. Exit from Portuguese territory is refused to minors who are Portuguese nationals or resident foreign nationals travelling unaccompanied by the person exercising parental responsibilities and who do not carry a legally certified authorisation granted by that person.
4 - É recusada a saída do território português a menores nacionais ou estrangeiros residentes que viajem desacompanhados de quem exerça as responsabilidades parentais e não se encontrem munidos de autorização concedida pelo mesmo, legalmente certificada.
5. Unaccompanied minors awaiting a decision on their admission to national territory or on their repatriation must be given all the material support and assistance needed to meet their basic needs for food, hygiene, accommodation and medical care.
5 - Aos menores desacompanhados que aguardem uma decisão sobre a sua admissão no território nacional ou sobre o seu repatriamento deve ser concedido todo o apoio material e a assistência necessária à satisfação das suas necessidades básicas de alimentação, de higiene, de alojamento e assistência médica.
6. Unaccompanied minors may be repatriated to their country of origin or to a third country willing to receive them only if there are guarantees that adequate reception and assistance will be provided to them on arrival.
6 - Os menores desacompanhados só podem ser repatriados para o seu país de origem ou para país terceiro que esteja disposto a acolhê-los se existirem garantias de que à chegada lhes sejam assegurados o acolhimento e a assistência adequados.
