1. Third-country nationals and stateless persons whose applications for international protection made at the border have not been accepted shall be subject to the border return procedure and must remain in the international zone of a port or airport, in a temporary detention centre or equivalent facility, or in another place in national territory duly designated for that purpose.
1 - Os nacionais de países terceiros e os apátridas cujos pedidos de proteção internacional apresentados na fronteira não tenham sido aceites ficam sujeitos ao procedimento de regresso na fronteira, devendo permanecer em zona internacional de porto ou aeroporto, em centro de instalação temporária ou espaço equiparado, ou noutro local em território nacional devidamente designado para o efeito.
2. Staying in the places referred to in the preceding paragraph shall under no circumstances confer authorisation to enter or stay in national territory.
2 - A permanência nos locais referidos no número anterior não confere, em caso algum, autorização de entrada ou permanência em território nacional.
3. The persons concerned shall be informed, in a language that they understand or may reasonably be presumed to understand, of the return decision, the grounds for it, the expected duration of the procedure and their rights and obligations.
3 - Os interessados são informados, numa língua que compreendam ou seja razoável presumir que compreendam, da decisão de regresso, dos respetivos fundamentos, da duração previsível do procedimento e dos direitos e deveres que lhes assistem.
4. Without prejudice to the preceding paragraph, the treatment and level of protection of persons subject to the border return procedure must comply with the applicable European Union law, ensuring a level of protection equivalent to that provided for in Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008 and in Regulation (EU) 2024/1349 of the European Parliament and of the Council of 14 May 2024, with the adaptations arising from their stay at the external border.
4 - Sem prejuízo do disposto no número anterior, o tratamento e o nível de proteção dos sujeitos ao procedimento de regresso na fronteira devem respeitar o disposto no direito da União Europeia aplicável, assegurando um nível de proteção equivalente ao previsto na Diretiva 2008/115/CE do Parlamento Europeu e do Conselho, de 16 de dezembro de 2008, e no Regulamento (UE) 2024/1349 do Parlamento Europeu e do Conselho, de 14 de maio de 2024, com as adaptações decorrentes da sua permanência na fronteira externa.
