1. While staying in the international zone of the port or airport or in a temporary detention centre or equivalent facility, a foreign national who has been refused entry into Portuguese territory may communicate with the diplomatic or consular representation of their country or with any person of their choice. They shall also be entitled to the assistance of an interpreter and to health care, including the presence of a doctor where necessary, and to all the material support needed to meet their basic needs.
1 - Durante a permanência na zona internacional do porto ou aeroporto ou em centro de instalação temporária ou espaço equiparado, o cidadão estrangeiro a quem tenha sido recusada a entrada em território português pode comunicar com a representação diplomática ou consular do seu país ou com qualquer pessoa da sua escolha, beneficiando, igualmente, de assistência de intérprete e de cuidados de saúde, incluindo a presença de médico, quando necessário, e todo o apoio material necessário à satisfação das suas necessidades básicas.
2. A foreign national who has been refused entry into national territory shall be guaranteed timely access to legal assistance from a lawyer, at their own expense or, on request, to legal aid (proteção jurídica). Law No. 34/2004 of 29 July shall apply, with the necessary adaptations, under the rules on the appointment of defence counsel for an accused person (arguido) for urgent procedural steps.
2 - Ao cidadão estrangeiro a quem tenha sido recusada a entrada em território nacional é garantido, em tempo útil, o acesso à assistência jurídica por advogado, a expensas do próprio ou, a pedido, à proteção jurídica, aplicando-se com as devidas adaptações a Lei n.º 34/2004, de 29 de julho, no regime previsto para a nomeação de defensor do arguido para diligências urgentes.
3. For the purposes of the preceding paragraph, the guarantee of legal assistance to foreign nationals refused admission may be the subject of a protocol to be concluded between the members of the Government responsible for internal administration, justice and migration and the Portuguese Bar Association (Ordem dos Advogados).
3 - Para efeitos do disposto no número anterior, a garantia da assistência jurídica ao cidadão estrangeiro não admitido pode ser objeto de um protocolo a celebrar entre os membros do Governo responsáveis pelas áreas da administração interna, da justiça e das migrações e a Ordem dos Advogados.
4. Without prejudice to the protection conferred by asylum law, a person who is the subject of a decision refusing entry shall also be guaranteed compliance, with the necessary adaptations, with the rules laid down in Article 143.
4 - Sem prejuízo da proteção conferida pela lei do asilo, é igualmente garantido ao cidadão que seja objeto de decisão de recusa de entrada a observância, com as necessárias adaptações, do regime previsto no artigo 143.º
