1. In determining income, only revenue and costs relating to assets or values that form part of the assets of the taxpayer’s sole proprietorship or that are allocated to the business and professional activities carried on by the taxpayer are taken into account.

#

2. Where any assets from the taxpayer’s private estate are allocated to the taxpayer’s business and professional activity, the acquisition value at which those assets are taken into account is their market value at the date of allocation, except for immovable property, whose acquisition value is the value of the property at the date on which the taxpayer acquired it, in accordance with the rules laid down in Article 45 or 46, as applicable.

#

3. Where assets allocated to the taxpayer’s business and professional activity are transferred to the taxpayer’s private estate, the value of the assets is their market value at the date of transfer.

4. The market value referred to in the preceding paragraphs, as attributed by the taxpayer at the time of the allocation or transfer of the assets, may be corrected whenever the Tax and Customs Authority considers, on stated grounds, that it does not correspond to the value that would be agreed between independent persons.

What we checked in this article
