1. Where temporary and life annuities, as well as benefits paid under supplementary social security schemes that are classified as pensions, include amounts paid by way of repayment of capital, the portion corresponding to capital is deducted in determining the taxable value.

2. Where the portion corresponding to capital cannot be separately identified, an amount equal to 85% is deducted from the total annuity for the purposes of determining the taxable value.

3. The preceding paragraphs do not apply to benefits due under supplementary social security schemes, whatever the paying entity or its designation, if the contributions giving rise to the right from which they derive were borne by a person or entity other than the beneficiary and have not been shown to have been taxed in the beneficiary’s hands.

4. Premiums and contributions giving rise to vested rights referred to in Article 2(3)(b)(3) that benefited from exemption are, in particular, deemed not to have been taxed in the beneficiary’s hands.
