1. The cash equivalent of income in kind, including where it takes the form of crypto-assets, is determined in accordance with the following rules, applied successively:
1 - A equivalência pecuniária dos rendimentos em espécie, incluindo quando assumam a forma de criptoativos, faz-se de acordo com as seguintes regras, de aplicação sucessiva:
c) In the case of produce, by the buying quotation on the Lisbon commodities exchange or, where there is no such quotation, by the average price for the year in question or the last price determined, as shown in the municipal price schedule (estiva camarária);
c) Tratando-se de géneros, pela cotação de compra na bolsa de mercadorias de Lisboa ou, não existindo essa cotação, pelo preço médio do respetivo ano ou do último determinado e que constem da estiva camarária;
d) By the prices of equivalent goods or services published by the National Statistics Institute (Instituto Nacional de Estatística);
d) Pelos preços de bens ou serviços homólogos publicados pelo Instituto Nacional de Estatística;
e) By the market value, under arm’s length conditions.
e) Pelo valor de mercado, em condições de concorrência.
2. In the case of the use of housing, the income in kind corresponds to the difference between the value of that use and the amount paid for it by the beneficiary, the value of use being determined in accordance with the following rules:
2 - Quando se tratar da utilização de habitação, o rendimento em espécie corresponde à diferença entre o valor do respetivo uso e a importância paga a esse título pelo beneficiário, observando-se na determinação daquele as regras seguintes:
a) The value of use is equal to the rent borne on behalf of the beneficiary;
a) O valor do uso é igual à renda suportada em substituição do beneficiário;
b) Where there is no rent, the value of use is equal to the amount of the controlled rent determined in accordance with the statutory criteria, but must not exceed one third of the total remuneration earned by the beneficiary;
b) Não havendo renda, o valor do uso é igual ao valor da renda condicionada, determinada segundo os critérios legais, não devendo, porém, exceder um terço do total das remunerações auferidas pelo beneficiário;
c) Where a residence allowance or equivalent is laid down by law for the situation in question for cases in which housing is not provided, the value of use may not in any case exceed that amount.
c) Quando para a situação em causa estiver fixado por lei subsídio de residência ou equivalente quando não é fornecida casa de habitação, o valor do uso não pode exceder, em qualquer caso, esse montante.
3. In the cases provided for in Article 2(3)(b)(5), the income is calculated as follows:
3 - Nos casos previstos no n.º 5) da alínea b) do n.º 3 do artigo 2.º, o cálculo do rendimento é feito do modo seguinte:
a) In the case of interest-free or reduced-rate loans granted by the employer, the income is calculated by subtracting the result of applying to the principal the interest rate, if any, borne by the beneficiary from the amount obtained by applying to that principal:
a) No caso de empréstimos concedidos pela entidade patronal sem juros ou a taxa de juro reduzida, o rendimento é calculado subtraindo o resultado da aplicação ao respetivo capital da taxa de juro que eventualmente seja suportada pelo beneficiário, ao resultado do valor obtido por aplicação a esse capital da:
1) The reference interest rate for the type of transaction in question, published annually by order (portaria) of the member of the Government responsible for finance; or
1) Taxa de juro de referência para o tipo de operação em causa, publicada anualmente por portaria do membro do Governo responsável pela área das finanças; ou
2) Failing publication of the order referred to in the preceding sub-point of this point, 70% of the minimum bid rate applicable to the main refinancing operations of the European Central Bank, or of another rate legally set as equivalent, on the first business day of the year to which the income relates;
2) Na falta de publicação da portaria referida no número anterior da presente alínea, 70 % da taxa mínima de proposta aplicável às operações principais de refinanciamento pelo Banco Central Europeu, ou de outra taxa legalmente fixada como equivalente, do primeiro dia útil do ano a que respeitam os rendimentos;
b) In the case of loans granted to the employee by other entities, the income corresponds to the portion of the interest borne by the employer.
b) No caso de empréstimos concedidos ao trabalhador por outras entidades, o rendimento corresponde à parte dos juros suportada pela entidade patronal.
4. The gains referred to in Article 2(3)(b)(7) are deemed to be obtained, respectively:
4 - Os ganhos referidos no n.º 7) da alínea b) do n.º 3 do artigo 2.º consideram-se obtidos, respetivamente:
a) At the time the option or a right with equivalent effect is exercised, corresponding to the positive difference between the value of the asset or right on that date and the exercise price of the option or right, plus any amount paid by the employee or member of a corporate body to acquire the option or right;
a) No momento do exercício da opção ou de direito de efeito equivalente, correspondendo à diferença positiva entre o valor do bem ou direito nessa data e o preço de exercício da opção, ou do direito, acrescido este do que eventualmente haja sido pago pelo trabalhador ou membro de órgão social para aquisição da opção ou direito;
b) At the time of subscription or of the exercise of a right with equivalent effect, corresponding to the positive difference between the subscription price or the exercise price of the right with equivalent effect for subscribers or holders of that right generally or, in the absence of other subscribers or holders, the market value, and the price at which the employee or member of a corporate body exercises it, plus any price paid by them to acquire the right;
b) No momento da subscrição ou do exercício de direito de efeito equivalente, correspondendo à diferença positiva entre o preço de subscrição ou de exercício do direito de efeito equivalente para a generalidade dos subscritores ou dos titulares de tal direito, ou, na ausência de outros subscritores ou titulares, o valor de mercado, e aquele pelo qual o trabalhador ou membro de órgão social o exerce, acrescido do preço que eventualmente haja pago para aquisição do direito;
c) At the time of the disposal, cash settlement or waiver of exercise, in favour of the employer or of third parties, of options, subscription rights or other rights with equivalent effect, corresponding to the positive difference between the price or value of the economic benefit received and any amount paid by the employee or member of a corporate body to acquire the options or rights;
c) No momento da alienação, da liquidação financeira ou da renúncia ao exercício, a favor da entidade patronal ou de terceiros, de opções, direitos de subscrição ou outros de efeito equivalente, correspondendo à diferença positiva entre o preço ou o valor da vantagem económica recebidos e o que eventualmente haja sido pago pelo trabalhador ou membro de órgão social para aquisição das opções ou direitos;
d) At the time the securities or equivalent rights are repurchased by the employer, corresponding to the positive difference between the price or value of the economic benefit received and their market value or, where that price or value was fixed in advance, the amount taken as the value of those assets or rights under point (a), or as the subscription or exercise price of the right for subscribers or holders of the right generally under point (b), or the market value under point (e);
d) No momento da recompra dos valores mobiliários ou direitos equiparados, pela entidade patronal, correspondendo à diferença positiva entre o preço ou o valor da vantagem económica recebidos e o respetivo valor de mercado, ou, caso aquele preço ou valor tenha sido previamente fixado, o quantitativo que tiver sido considerado como valor daqueles bens ou direitos, nos termos da alínea a), ou como preço de subscrição ou de exercício do direito para a generalidade dos subscritores ou dos titulares do direito, nos termos da alínea b), ou o valor de mercado, nos termos da alínea e);
e) In plans for the allocation of securities or equivalent rights in which the following cumulative conditions are met on the part of the employer: the securities or rights are not acquired or registered in favour of the employees or members of corporate bodies; the latter are unable to enter into transactions disposing of or encumbering them; and they are subject to a restriction period that excludes them from the plan if the employment relationship or corporate office ends, at least where this is at the employer’s initiative with just cause, even if other rights inherent in holding them are acquired, such as the right to income or to participation as a member, at the time the employees or members of corporate bodies become fully vested with the rights inherent in those securities or rights, in particular the rights of disposal or encumbrance, the gain being determined as the positive difference between the market value at the end of the restriction period and any amount paid by the employee or member of a corporate body to acquire those securities or rights.
e) Nos planos de atribuição de valores mobiliários ou direitos equiparados em que se verifiquem pela entidade patronal, como condições cumulativas, a não aquisição ou registo dos mesmos a favor dos trabalhadores ou membros de órgãos sociais, a impossibilidade de estes celebrarem negócios de disposição ou oneração sobre aqueles, a sujeição a um período de restrição que os exclua do plano em casos de cessação do vínculo ou mandato social, pelo menos nos casos de iniciativa com justa causa da entidade patronal, e ainda que se adquiram outros direitos inerentes à titularidade destes, como sejam o direito a rendimento ou de participação social, no momento em que os trabalhadores ou membros de órgãos sociais são plenamente investidos dos direitos inerentes àqueles valores ou direitos, em particular os de disposição ou oneração, sendo o ganho apurado pela diferença positiva entre o valor de mercado à data do final do período de restrição e o que eventualmente haja sido pago pelo trabalhador ou membro de órgão social para aquisição daqueles valores ou direitos.
5. Where the employer grants the use of a motor vehicle, the annual income corresponds to 0.75% of its market value as at 1 January of the year in question multiplied by the number of months for which the vehicle is used.
5 - Quando se tratar da atribuição do uso de viatura automóvel pela entidade patronal, o rendimento anual corresponde ao produto de 0,75 % do seu valor de mercado, reportado a 1 de janeiro do ano em causa, pelo número de meses de utilização da mesma.
6. Where the vehicle is acquired by the employee or member of a corporate body, the income corresponds to the positive difference between its market value and the sum of the annual income taxed as income arising from the grant of its use and the amount paid as the purchase price.
6 - No caso de aquisição de viatura pelo trabalhador ou membro de órgão social, o rendimento corresponde à diferença positiva entre o respetivo valor de mercado e o somatório dos rendimentos anuais tributados como rendimentos decorrentes da atribuição do uso com a importância paga a título de preço de aquisição.
7. In determining the income provided for in paragraphs 5 and 6, the market value is the difference between the acquisition value and the product of that value and the accumulated depreciation coefficient set out in a table to be approved by order (portaria) of the member of the Government responsible for finance.
7 - Na determinação dos rendimentos previstos nos n.os 5 e 6, considera-se valor de mercado o que corresponder à diferença entre o valor de aquisição e o produto desse valor pelo coeficiente de desvalorização acumulada constante de tabela a aprovar por portaria do membro do Governo responsável pela área das finanças.
