2. To prove compliance with the requirement laid down in point (d)(ii) of Article 3 of Law No. 23/2007 of 4 July, as amended, the applicant shall submit the individual employment contracts concluded with the workers.

7. To prove compliance with the requirement laid down in point (d)(v) of Article 3 of Law No. 23/2007 of 4 July, as amended, the applicant shall submit:

b) A declaration issued by a public or private scientific research institution forming part of the national scientific and technological system, attesting the actual transfer of that capital;

8. To prove compliance with the requirement laid down in point (d)(vi) of Article 3 of Law No. 23/2007 of 4 July, as amended, the applicant shall submit:

a) A declaration issued by the beneficiary entity, attesting the actual transfer of the legally required capital;
a) Declaração emitida pela entidade beneficiária, atestando a transferência efetiva do capital legalmente exigido;
b) A declaration issued by the Office for Cultural Strategy, Planning and Assessment (Gabinete de Estratégia, Planeamento e Avaliação Culturais), after consulting the culture department with responsibilities in the sector, attesting that the capital constitutes investment in or support for artistic production, or the recovery or maintenance of the national cultural heritage;
b) Declaração emitida pelo Gabinete de Estratégia, Planeamento e Avaliação Culturais, ouvido o serviço da área da cultura com atribuições no setor, atestando a natureza de investimento ou apoio à produção artística, recuperação ou manutenção do património cultural nacional;
9. To prove compliance with the requirement laid down in point (d)(vii) of Article 3 of Law No. 23/2007 of 4 July, as amended, the applicant shall submit:
9 - Para prova do cumprimento do requisito previsto na subalínea vii) da alínea d) do artigo 3.º da Lei n.º 23/2007, de 4 de julho, na sua redação atual, o requerente deve apresentar:
a) A certificate proving ownership of the fund units, free of charges and encumbrances, issued by the entity responsible for keeping an up-to-date register of unit holders under the law, the fund’s management regulations or a contractual instrument;
a) Certificado comprovativo da titularidade das unidades de participação, livre de ónus e encargos, emitido pela entidade à qual caiba a responsabilidade de manter um registo atualizado dos titulares de unidades de participação, nos termos da lei, do respetivo regulamento de gestão ou de instrumento contratual;
b) A declaration issued by the management company of the investment fund concerned, attesting the viability of the capitalisation plan, a maturity of at least 5 years and the application of at least 60% of the investment in commercial companies with their registered office in national territory;
b) Declaração emitida pela sociedade gestora do respetivo fundo de investimento, atestando a viabilidade do plano de capitalização, a maturidade de, pelo menos 5 anos, e aplicação de pelo menos 60 % do investimento em sociedades comerciais sediadas em território nacional;
10. Compliance with the requirement laid down in Article 3(1)(d)(viii) of Law No. 23/2007 of 4 July, as amended, is demonstrated through access to information proving the incorporation of a commercial company with share capital equal to or greater than the legally required amount or, in the case of the acquisition of a shareholding, through access to information attesting that the shareholding is held and to information proving the contract by which it was acquired, stating the acquisition price, with the Agency for Integration, Migration and Asylum (AIMA) verifying the social security position of its own motion.
10 - A demonstração do cumprimento do requisito previsto na subalínea viii) da alínea d) do n.º 1 do artigo 3.º da Lei n.º 23/2007, de 4 de julho, na sua redação atual, é feita através do acesso a informação comprovativa da constituição de sociedade comercial com capital social igual ou superior ao legalmente exigido ou, no caso de aquisição de participação social, do acesso a informação que ateste a detenção da participação e a informação comprovativa do contrato por meio do qual se realizou a respetiva aquisição, com indicação do valor de aquisição, verificando a AIMA, I. P., oficiosamente a situação perante a segurança social.
11. In addition to the documents provided for in the preceding paragraphs, the applicant shall submit a declaration from the credit institution authorised or registered in national territory with the Banco de Portugal, attesting the actual transfer of an amount equal to or greater than the legally required amount.
11 - Para além dos documentos previstos nos números anteriores o requerente deve apresentar declaração da instituição de crédito autorizada ou registada em território nacional junto do Banco de Portugal, atestando a transferência efetiva de montante igual ou superior ao exigido legalmente.
14. Proof that the tax and contribution position is regularised is provided by the applicant submitting an up-to-date certificate of no debt issued by the Tax and Customs Authority (AT) and by social security or, where that is not possible, a declaration that no record exists with those entities.
14 - A prova da situação tributária e contributiva regularizada efetua-se mediante a apresentação, pelo requerente, de declaração negativa de dívida atualizada emitida pela AT e pela segurança social ou, na sua impossibilidade, declaração de não existência de registo junto destas entidades.
15. The applicant shall submit a declaration on their honour attesting compliance with the minimum quantitative and time requirements of the investment activity in national territory.
15 - O requerente deve apresentar declaração, sob compromisso de honra, atestando o cumprimento do requisito quantitativo e temporal mínimos da atividade de investimento em território nacional.
16. The means of proof and the declaration referred to in the preceding paragraphs are submitted at the time of the application for the grant of the residence permit, which is preceded by electronic registration on a platform set up for that purpose.
16 - Os meios de prova e a declaração referidos nos números anteriores são apresentados no momento do pedido de concessão de autorização de residência, precedido de registo eletrónico em plataforma para o efeito.
17. The decision on the application lies with the board of directors of AIMA.
17 - A decisão sobre o pedido é da competência do conselho diretivo da AIMA, I. P.
18. AIMA may request an opinion from the competent national bodies on compliance with the legal requirements applicable by reason of the investment.
18 - A AIMA, I. P. pode solicitar a entidades nacionais competentes parecer sobre o cumprimento dos requisitos legais em razão do investimento.
