1. Public authorities, in particular the judicial authority, the criminal police bodies competent to investigate offences of trafficking in human beings or of aiding illegal immigration, police authorities and associations working in the field of victim protection, shall inform the foreign national in writing, with a copy to the Agency for Integration, Migration and Asylum (AIMA), of the possibility of being granted a residence permit under Law No. 23/2007 of 4 July, as amended.
2. The communication to AIMA by the authorities responsible for the investigation of their request for cooperation, or of the person’s expressed willingness to cooperate with them, starts the reflection period provided for in Article 111(1) of Law No. 23/2007 of 4 July, as amended, provided that there are indications that the person concerned is a victim of trafficking in human beings or of an act of aiding illegal immigration.
3. During the statutory minimum reflection period, the authority responsible for the criminal investigation issues an opinion on whether the requirements laid down in Article 109(2)(a) to (c) of Law No. 23/2007 of 4 July, as amended, are met, for the purpose of AIMA initiating the procedure for the grant of a residence permit or, where those requirements are not yet met, of extending the reflection period up to a maximum of 60 days.
4. Where the authority responsible for the investigation considers that the foreign national unequivocally shows a willingness to cooperate in the investigation, and considers that there are strong indications that such cooperation is not fraudulent and that the victim’s complaint is neither unfounded nor fraudulent, it shall state this in the communication referred to in paragraph 2 of this provision, so that the procedure for the grant of the residence permit and the application of the measures provided for in Article 112 of Law No. 23/2007 of 4 July may begin immediately.
