1. A residence permit is granted to a foreign national who is or has been a victim of criminal offences linked to trafficking in human beings or to aiding illegal immigration, even if they entered the country illegally or do not meet the conditions for the grant of a residence permit.
1 - É concedida autorização de residência ao cidadão estrangeiro que seja ou tenha sido vítima de infracções penais ligadas ao tráfico de pessoas ou ao auxílio à imigração ilegal, mesmo que tenha entrado ilegalmente no País ou não preencha as condições de concessão de autorização de residência.
2. The residence permit referred to in the preceding paragraph is granted after the end of the reflection period provided for in Article 111, provided that:
2 - A autorização de residência a que se refere o número anterior é concedida após o termo do prazo de reflexão previsto no artigo 111.º, desde que:
a) It is necessary to extend the stay of the person concerned in national territory, taking into account the value of their presence for the investigations and judicial proceedings;
a) Seja necessário prorrogar a permanência do interessado em território nacional, tendo em conta o interesse que a sua presença representa para as investigações e procedimentos judiciais;
b) The person concerned shows a clear willingness to cooperate with the authorities in the investigation and suppression of trafficking in human beings or of aiding illegal immigration;
b) O interessado mostre vontade clara em colaborar com as autoridades na investigação e repressão do tráfico de pessoas ou do auxílio à imigração ilegal;
c) The person concerned has severed the relations they had with the presumed perpetrators of the offences referred to in the preceding paragraph.
c) O interessado tenha rompido as relações que tinha com os presumíveis autores das infracções referidas no número anterior.
3. The residence permit may be granted before the end of the reflection period provided for in Article 111 if the person concerned is considered to meet unequivocally the criterion laid down in point (b) of the preceding paragraph.
3 - A autorização de residência pode ser concedida antes do termo do prazo de reflexão previsto no artigo 111.º, se se entender que o interessado preenche de forma inequívoca o critério previsto na alínea b) do número anterior.
4. A residence permit may also be granted, after the end of the reflection period provided for in Article 111, to a foreign national identified as a victim of trafficking in human beings under special legislation, with exemption from the conditions laid down in paragraph 2(a) and (b).
4 - Pode igualmente ser concedida após o termo do prazo de reflexão previsto no artigo 111.º autorização de residência ao cidadão estrangeiro identificado como vítima de tráfico de pessoas, nos termos de legislação especial, com dispensa das condições estabelecidas nas alíneas a) e b) do n.º 2.
5. A residence permit granted under the preceding paragraphs is valid for a period of one year and renewable for equal periods if the conditions listed in paragraph 2 continue to be met or if the person identified as a victim of trafficking in human beings continues to need protection under special legislation.
5 - A autorização de residência concedida nos termos dos números anteriores é válida por um período de um ano e renovável por iguais períodos, se as condições enumeradas no n.º 2 continuarem a estar preenchidas ou se se mantiver a necessidade de protecção da pessoa identificada como vítima de tráfico de pessoas, nos termos de legislação especial.
